1)      Can Janardan Rai Nagar Rajasthan Vidyapeeth( Deemed University) offer Diploma Engineering, B.Tech, M.Tech programmes under distance education?

2)      Janardan Rai Nagar Rajasthan Vidyapeeth( Deemed University) does not have any Engineering Department & also does not offer any type of Diploma Engineering, B.Tech, M.Tech on their regular campus through conventional mode so Can Janardan Rai Nagar Rajasthan Vidyapeeth( Deemed University) offer Diploma Engineering, B.Tech, M.Tech programmes under distance education?

3)      If Yes, please provide documents issued by your office to Janardan Rai Nagar Rajasthan Vidyapeeth((Deemed University) for offering Diploma Engineering, B.Tech, M.Tech programmes under distance education & upto what period.

4)      Can Janardan Rai Nagar Rajasthan Vidyapeeth( Deemed University) take new admissions for Diploma Engineering, B.Tech, M.Tech under distance education.

It is clear from answer to Q. 1 (see first scanned document below) that Janardan Rai Nagar Vidyapeeth (Deemed University) cannot offer Diploma Engineering, B.Tech , M.Tech programmes under distance education. Still the website of the University (http://www.rvduniversity.com/index.php?option=com_content&view=article&id=28&Itemid=27) clearly shows that it is not complying with the regulations.

    We at RTI Anonymous are planning to file a Public Interest Litigation (PIL) against the University.

        First of all, I would like to tell you that our team has filed a Right to Information Application to IGNOU and not a complaint that will close Janardan Rai Vidyapeeth.
        To have information about each and every happening in our country is our constitutional right. If I want to know any thing about any university, it should not be a problem to you.
        Secondly, if any institution is giving degrees that it is not authorized to give,the degrees are as it is null and void. No other institute on this earth will recognize the degree obtained by the student and hence the time and money employed by the student for obtaining the degree will be futile. Hence by our endeavor we are saving the time, money and career of several students.
        In fact, if the institution is not authorized to give such degrees then the students of the institution must themselves sue the institution for deceiving them and playing with their time, money and careers.

            Yes Sir, I agree that the students enrolled in RVDU might have a lot of problems as they might not get valid degrees from the institution .
            But isn’t it better to raise this topic earlier rather than complete their entire course and waste their time and money to obtain a fake degree.

                Rahul, Corruption isnt bad only when it doesnt negatively impact you personally. If you are trying to protect the university because you now have their degree, you are no different from the politicians.
                Take the right stand against corruption and prevent other future students from falling into the university’s trap. You can always appeal against any negative impact this will have for students who already have the degree. Put nation’s interest above your own, especially when it helps you encourage what is right.

          just a simple life cycle as what happened:
          jrn university––issues degree––notice by ugc–—jrn applied for ex post facto approval-—-ugc asked JRN to get DEC approval and not AICTE——-DEC gives one time ex post facto approval——UGC ratifies—-—Joint committee of UGC AICTE DEC in 2007 ratifies it—-—publication in new paper—-—MHRD asks DEC and not AICTE to stop giving approval for distance B-Tech in 2010—-—DEC sends notice to all universities to stop imparting distance B-Tech. SIMPLE
          MHRD is the Karta of AICTE;UGC:DEC.
          The degrees are valid and approved with one Time post facto approval till 2005 and 2007-2008.

      igot ur reply but we are in last year so we have waste our half study life there … so now according to u v should start our career again and study again engineering from the begeinning..
      i m notable to understand this answer.. after studying 3 years we shoul study and waste 4 more years is this right

However even if you would have completed your education without knowing the facts about your institute, it would be of no use as the degree that you would receive might be invalid.We have not incremented your problem through our action, in fact we are trying to help you.

            Rahul, it wasnt the RTI anonymous’ fault that you joined a university without checking its credentials and that the university cheated you.
            They are only helping to unearth fraud. If you have invested 3 years studying in a fraudulent institution, you should go to courts complaining about the university.

      As per information i gathered,this degree is Valid for getting Job in Govt Sector.And for higher studies through GATE.Govt of West Bengal is accepting such degree at par of Known Universities.Many candidates have got fresh appointment as Assistant Engineer with such degree.The Institution of Engineers(India) also accepting these degree for their Associate Membership.

      6. With regard to question 1 to 4, Is the candidate who is holding above mentioned MTech Engineering Degree through distance education mode applicable for some post in an engineering college affiliated by AICTE where minimum qualification requirement is ME/MTech as per AICTE guidelines?

Kindly specify the AICTE’s stand regarding joint committee’s (UGC-DEC-AICTE) ex-post-facto approval given to like IASE Deemed University SardarShahar Udaipur, Rajasthan and Allahabad Agriculture Institute Deemed University, Allahabad, Uttar Pradesh, that weather the ex-post-facto approval is applicable to Engineering courses like BE/BTech/ME/MTech through distance education mode or not is recognized by AICTE or not.
      8. With regard to question 1 and 2, if yes, then kindly justify AICTE’s stand in case of ruling given in one of the recent hearings by Central Administrative Tribunal (CAT) – Delhi for “Sh. S. C. Jain vs Union Of India” on 21 December, 2011 (Kindly verify the details at http://www.indiankanoon.org/doc/103101414/). Please note that the candidates (petitioners) in question in this case have taken admission in year 2003 and tribunal decision is against the petitioner.

With regard to above mentioned universities, if the above mentioned courses in question are not recognized by AICTE, then what action has AICTE taken or going to take in future to inform the Universities and AICTE approved engineering institutions in the country where these fake degree holders are getting enrolled for further studies or are working in various capacities?

    Thank you very much for your initiative. Reply from DEC is very confusing. They have ruined the future of lakhs of innocent students. These university people are very powerful & know the loop holes of system. Now DEC says matter is sub judice so we don’t know how many years it will take to get justice & till then janardan Rai Nagar Rajasthan vidyapeeth (Deemed University) will continue selling fake Engineering certificate to innocent needy students. Sir I request you to file PIL soon to expose & punish this corrupt University under IPC or other laws & prevent other corrupt universities not to think cheating innocent students in the name of university distance education programmes.

    You have enough documents on this post, which you can download, as proof and file a PIL yourself.

    Many students have gone to Consumer court in their respective states & some of them have got full refund with interest through Hon. Consumer court. You also can go to Consumer Court with the documents posted on this website & also attach the refusal letter from your department. I am confident that you will get full refund with interest. Ramesh, since you are brave enough to come out openly so I request you to file PIL by yourself & I assure you thousands will join you. We have been cheated by this corrupt University so we must stop this fraud & malpractice. There are many students who have paid University fees by taking private loan on high interest. Their careers have been ruined because certificates are not valid. RTI Anonymous Team members have done lot for us & we are really very grateful to them. We also have to do something to teach lesson to this corrupt University to save career of lakhs of innocent students like you & I am 100% sure that RTI Anonymous Team members will always help us.

    Please see that, what a “DRAMA” is playing by MHRD,AICTE,DEC and DEC in front of students who are already enrolled for B.Tech./Diploma (Technical Qualification)or who have passed these Degee/Diploma through distance education mode from different Universities/Deemed Universities/Deemed to be Universities forwhich students have spent lacs of rupees and valueable time,almost students are working.

    Now MHRD says that no further admission should be continue for B.Tech./Diploma through distance mode w.e.f.29.07.2009.

    What will future of students who have enrolled before 29.07.2009 and passed the Degree/Diploma after 29.07.2009.

    AICTE says that they did not recognized the qualifications acquired through distance mode.

    DEC says that distance technical qualification should be approved by Joint Committee of DEC ie AICTE,DEC & UGC and the matter is in the Court.

    Concerned Universities says that approval of UGC is not required as the University is approved by DEC,and University is Accredited by NAAC with the grade as A++,B++ etc,etc.

    Now kindly see the above note/remarks by the Government and their appointed bodies ie AICTE,DEC&UGC,they are confusing badly the students.

    Is Government/AICTE/DEC/UGC sleeping,what happening in regards of approvals of said Universities.

    This is the lapses on the part of Government /Competant Authorities,due this lapses lacs of students are suffering and harrassing badly.

    In last I will request to the RTI team/Consumer forms and Government also to take necessary action for the sake of these UNFOTUNATE STUDENTS who are being harrassed and demoralised by their deptt./company where they are working.

              Sir I had taken admission in B.Tech. after passing three years Diploma in regular course from U.P. Technical Board,hence as per Govt. guidelines diploma holder student gets one year relaxation, ie he can get admission direct in second year (in III rd semester).
              Accordingly I had taken admission in Jan.2008 in III rd semester and passed the examinations as per following order:
              III rd semester passed : June 2008
              IV th semester passed : Dec 2008
              V th semester passed : June 2009
              VI th semester passed : Dec 2009
              VII th semester passed : June 2010
              VII th semester passed : Dec 2010
              From the above it is clear that period wise no problem ie degree received after completion of three years (In lateral entry mode).
              Therefore kindly see possitively and send this note to an expert who know all the rules and regulations of education /Universities for distance B.Tech.
              Kindly inform accordingly.

I called on the numbers, given by you and asked them about Distance Education Engineering Programmes. They told me these are University Campus numbers where regular Courses are taught & gave me two numbers 0294-2491514,0294-2494365 for Distance Education enquiry. I called on both the numbers & found that 0294-2494365 is Telefax & no one came to attend that number. As far as 0294-2491514 is concerned, I have been trying since last one hour but continuous engage tone is coming except three times it rang but no one called me ‘HELLO’ from other side. Thus no official responce yet !!!

      Please write a letter to MHRD and ask them whether you are eligible of not. Attach the proofs of the documents from the RTI applications
      Also, get hold of a lawyer and file a case against this university, with the proofs provided above

      If you have taken the course thru Regular Classes it is valid.. Only the B.Tech Degree under Distant Education is troublesome..

      FYI: In case of cancellation of any authorization, all the degree awarded will stand valid ( unless they are awarded on wrong ground ). I am very sure about this..

      If you have a degree by taking the distant education then its invalid..

      Also, the university cannot grant any degree once the regulatory authority decides to revoke its approval. In case if there are any degrees awarded after revoke of approval then it stands void..

      I am based in USA and most people who file these RTI’s are students from IIT kharagpur and other well meaning RTI activists. We would definitely know quite a lot on how RTI’s can be drafted/filed and followed up. But, once we expose the scam we really want people like you to pursue it further either by filing a law-suit or a complaint to the MHRD.
      I can give you a phone call and talk further , but frankly other than being sympathetic to your problems, I cannot provide any real tangible solutions (apart from what I have mentioned above)

      As per MHRD letter, those who are take admission before July 2009, in any university/college , the distance education (B Tech/Diploma) degree is valid. One of my friend Mr Ragu, he was completed DME during 2010 and presently working in Govt Departmet, while he was submitted the certificate for publication of DO-II, the Office sent all documents for verification and the University has clarified that the certificate is Gunuine and All distance education cources are approved by UGE-AICTE-DEC.Letter is attatched herewith for your further your information

    Sir I go through the web site of RVD University but I could not see the relevent document which shows ,who have enrolled before 29/07/2009 are valid degree holder.I had taken admission in 2008 in lateral entry ie after passing three year Diploma in civil engineering accordingly I have passed B.Tech.(civil) in Dec 2010 from JRN Rajasthan Vidyapeeth University.But my deptt.is refusing to add this degree in my service record with the remark that this degree is not recognized by AICTE.My enrollment no. is DE-I/08/143293.
    In view of the aboe circumstances kindly
    suggest me and please post/send all the relevent documents ,in the absence of above all my promotion is held-up.

    In the last paragraph of this letter, it says that University must follow the norms prescribed by concerned regulatory bodies & seek their approval for professional/technical programmes as per requirement. We all know that MHRD has banned Engg. programmes through distance education. So how through this letter, University got continuation of provisional recognition for taking new admission in Engg. programmes under distance education from DEC or from other authorities? Again DEC says that matter is sub judice & they are fighting on the same issue in Delhi High Court. This letter has been issued for other courses like BA, BCOM, MA… etc but not for Engg. programmes. So dear Friend University is misleading innocent students like you by showing this type of letter. You should go to consumer court to get proper justice & also to teach them proper lesson.

    dear friends!as per notification no44 Government of India dated 1-3-95,for distance education degrees recognization it is mandatory
    to get the approval of DEC and in case of technical degrees approval of AICTE is mandatory .Till today AICTE have not given approvals for degrees/diplomas awarded through distance mode in technical education.And it is further clarified that it is a policy of AICTE not to approve through such degrees/diplomas,hence there is no scope for recognization of the above degrees.Further UGC has also not approved the degrees and not given permission to deemed universities to conduct programs under distance education in both technical and non technical fields.All these deemed universities warned not to open study centers
    for conducting distance education program by the DEC,UGC and AICTE .In their letter dated 13th may ,2003.A public notice was also published on 26-11-2005 and 11-7-2006 cautioning the parents and students by the DEC.Mostly in-service employees have joined these courses and obtained degrees within a year or two.This scam need to enquired. Interested persons may go through the judgements in W.P.No.22922/2006 and batch of honorable AP high court and OWPNo.674/2010 of
    honorable Jammu and Kashmir high court.Thank You.

    Sir, I took admission in 4 yrs Btech Civil Distance learning programme in year 1998 and passed out in year 2001 from IGNOU. Is this degree valid and is this come under purview of joint committeee of UGC,AICTE AND DEC which was constituted in 2007. Does MHRD order of withdrawing btech from distance education effects my degress also ? Indeed if its so then it should be effected on all the technical programmes ever started in 1980s and what about those people who have taken the benefit and left to heavenly jouney after completing their age on earth ?/ please help.. My department is also harrassing me for this now in 2012 .. Regards

V/TS.IV dated 1st March 1995, states that ‘…..On the recommendations of the Board of Assessment for Educational Qualifications, the Government of India has decided that all the qualifications awarded through Distance Education by the Universities established by an Act of Parliament or State Legislature, Institutions Deemed to be Universities under section 3 of the UGC Act, 1956 and Institutions of National Importance declared under an Act of Parliament stand automatically recognized for the purpose of employment to posts and services under the Central Government, provided it has been approved by Distance Education Council, Indira Gandhi National Open University and wherever necessary by All India Council for Technical Education, New Delhi…..….’
    Point 1: This is what DEC says regarding post facto recognition:
    As per the information provided by the Distance Education Council(DEC), the DEC has accorded Post facto recognition till 2005 to following Universities in 2007 to offer programmes through distance mode on the basis of recommendation of a committee formed to examine their proposal. The report got approved in the third joint committee meeting of UGC-ACITE-DEC.
    Point 2: This the Policy of AICTE:
    AICTE link(http://www.aicte-india.org/downloads/public_notice_distance_education.jpg) states that, so far none of the engineering courses through distance education mode has been given approval.

    Now question arises regarding the following universities (which were running engineering as well as other degree courses through distance education mode).
    1.JRN Rajasthan Deemed University Udaipur
    2. IASE Deemed University, Sardarshahr
    3. Vinayak Mission University Salem
    4. Allahabad Agricultural University, Allahabad

    1. Was the committee, aware about the fact that these Universities were offering Engineering Programmes (B.Tech/BE, MTech/ME, Engineeing Diploma or not) before giving post facto approval or post facto approval is not applicable to these engineering courses but only to other non engineering degree courses?”
    2. If yes, have they got the AICTE approval or not?
    3. As AICTE Nominee was there in the joint committee meeting, as per his knowledge these Universities have got the AICTE approval or not?
    As per the information provided by the DEC, some universities like JRN and IASE Deemed Universities got the provisional recognition to offer programmes through distance mode for one academic year 2007-08, for programmes approved by the statutory bodies of the University. But for the Engineering Programmes they need separate approval from the AICTE, as per the Gazette Notification 44 and as per the information provided by the DEC.

    So as per information available with the MHRD, have these Universities got the approval from the AICTE to offer Engineering Programmes (B.Tech/BE, MTech/ME, Engineeing Diploma or not) through distance mode.
    Now point 1(DEC version) and point 2 (AICTE policy) are creating confusions. Which one of these two is true?
    if any one of you have got some information related to this, kindly share the same?

    Just go through following story also:

    ‘Agriculture superintending engineer produced fake certificate to get promotion’
    TNN Jun 24, 2012, 12.26AM IST

    HYDERABAD: A probe by the vigilance and enforcement department has established that the B Tech degree certificate produced by a senior engineer in the agriculture and marketing department in order to get promoted to the rank of superintending engineer (SE) was fake.
    K Radhakrishna Murthy was promoted to his present rank based on a B Tech (Civil) degree in August 2009. Later, a complaint received by the department stated that the degree, which he secured in 2006 from Institute of Advanced Studies in Education (IASE), a deemed university of Rajasthan, was fake and not valid.
    The then marketing commissioner referred the matter to AP Lokayukta. A thorough probe was also ordered by vigilance and enforcement officials to check if Radhakrishna Murthy misled the government. As per rules, to get promoted to the rank of SE, a candidate must have a BE degree from any recognised university under Central Act or State Act. Murthy produced a B Tech degree from IASE through distance mode. Without verifying the the certificate, the department promoted him to the SE rank.
    Later, the vigilance department got the certificate verified by UGC, Distance Education Council of India and AICTE. The UGC informed the AP State Council of Higher Education (APSCHE) that IASE was not granted approval to run the B Tech course through distance mode. The Distance Education Council of India, New Delhi, confirmed it. AICTE made it clear that it had not accorded any permission to IASE to run engineering courses in distance mode.
    The vigilance inquiry report (No.15(438/V&E/E1/2010-HYD City-II) said that the certificate produced by Murthy was not valid as the institute was not approved by the UGC, DEC and AICTE. The report observed that Murthy had misled the screening committee by knowingly suppressing the facts regarding the validity of his degree.
    Now, the department of agriculture marketing and cooperation had issued a memo to the SE to produce his original certificate for verification. If he fails to do so, he may be demoted.

    The meeting of the U.G.C.-A.I.C.T.E.-D.E.C, Joint Committee was held on 7th August, 2007, at 2:30 p.m. in the Board Room, Block-8, IGNOU Campus, Maidan Garhi, New Delhi – 110 068. The following members were present:

    1. Confirmation 2nd Joint Committee meeting minutes
    At the outset the Chairman welcomed all the members. The members present reviewed the minutes of the 2nd Joint Committee meeting. Two changes were notified by the members in the minutes which are given below:

    Item no.1 :no.1: The format for procuring information from the Distance Education Institutions (DEIs)
    The last line should read as follows:
    “…the letter which would be issued to the institution by the Chairman of DEC, should specify the programmes for which approval is granted.”

    Item no. 4 :4: Any other item.
    In the letter to be sent to SCDL the following should be included:
    “SCDL can take up fresh admissions only after getting due recognition from DEC.”

    2. Recognition of institutions
    It was decided that only universities should be given provisional recognition for a period of one year i.e. for the academic year 2007-08. All other institutions, including private universities/ institutions, should apply to DEC in the new format for recognition and should adhere to the Handbook (2007) Recognition of Open and Distance Learning Institutions.

    3. Institutions applied for ex-post-facto approval
    The Joint Committee accepted the recommendations of the Committee appointed by DEC for examining the institutions that have applied for ex-post-facto approval to
    DEC. It accepted the recommendations of granting ex-post-facto approval to all the
    four institutions namely JRN Rajasthan Vidyapeeth, Allahabad Agriculture Institute Deemed University, Vinayaka Missions University, Punjab Technical University and IASE Deemed University up to the current academic year i.e. 2007-08 and the suggestions made by the visiting Expert Committee should be made known to them which should be strictly adhered to. However, they need to apply for formal recognition to DEC for the next academic year.

    4. Recognition of institutions by DEC
    All institutions that have applied to DEC for recognition should be asked to apply in the new form developed by DEC for institutional recognition. The Chairman, DEC would constitute committees for visiting all the institutions to examine their preparedness to offer programmes through distance mode and review the satisfactory compliance of norms laid down by DEC.

    5. Joint Committee Meetings
    It was decided that as far as possible the Joint Committee should meet once a month preferably on fourth Friday of every month.

    He has given one link related to judgement given by Delhi high court. I has studied the whole judgement, in his judgement number of judgements given by other high courts have been discussed in full details. Just go through this judgements details, which clearly states that all degrees done by mean of study centres of various universities wheather in 2003 or in 2008, they all are fake. Here even MHRD decision as shown by you is also ruled out. The supreme courts judgement against Annamalai university also considering this whole thing as crap. Also check the circular of UGC regarding study centres.

    As per the Minisitry of Human Resource Development, Govt of India Gazette notification No. 44 F.No. 18-15/93-TD. V/TS.IV dated 1st March 1995, states that ‘…..On the recommendations of the Board of Assessment for Educational Qualifications, the Government of India has decided that all the qualifications awarded through Distance Education by the Universities established by an Act of Parliament or State Legislature, Institutions Deemed to be Universities under section 3 of the UGC Act, 1956 and Institutions of National Importance declared under an Act of Parliament stand automatically recognized for the purpose of employment to posts and services under the Central Government, provided it has been approved by Distance Education Council, Indira Gandhi National Open University and wherever necessary by All India Council for Technical Education, New Delhi…..….’

    Point 1: This is what DEC says regarding post facto recognition:

    As per the information provided by the Distance Education Council(DEC), the DEC has accorded Post facto recognition till 2005 to following Universities in 2007 to offer programmes through distance mode on the basis of recommendation of a committee formed to examine their proposal. The report got approved in the third joint committee meeting of UGC-ACITE-DEC.

    Point 2: This the Policy of AICTE:

    AICTE link(http://www.aicte-india.org/downloads/public_notice_distance_education.jpg) states that, so far none of the engineering courses through distance education mode has been given approval.

    This is what UGC says about study centers:

    The University Grants Commission has been receiving a large number of letters from individuals and organizations seeking clarifications about study centres of Deemed to be Universities particularly those associated with the following three Deemed to be

    1) Janardan Rai Nagar (JRN) Rajasthan Vidyapeeth, Udaipur (Rajasthan)
    2) Allahabad Agricultural Institute,(AAI) Allahabad (Uttar Pradesh)
    3) Institute of Advanced Studies in Education of Gandhi Vidya Mandir,
    (IASE), Sardarshahr, (Rajasthan)
    In this context, the public at large and students in particular are informed as
    under:-
    1. The Deemed to be Universities are empowered to award degrees specified by the
    UGC under Section 22 of its Act.
    2. The Deemed to be Universities are not permitted to affiliate any college/institute.
    3. The Deemed to be Universities can start new departments within the university
    campus or start off-campus centres with prior specific permission of the UGC and
    that too of the State Government where the centre is proposed to be opened.
    4. The Deemed to be Universities can set up off-shore campus only after due
    permission from the Government of India and on the recommendations of the
    UGC and also that of the Government of the host country.
    5. The Deemed to be Universities can offer Distance Education Programme only
    through its own study centres and that too with the specific approval of both the
    UGC and Distance Education Council.
    6. Private Franchising of higher education is not permissible.
    7. As of today, UGC has not approved the study centres of any Deemed to be
    Universities including the above three Deemed to be Universities.
    The students, parents and public at large are advised to take note of the above
    points while seeking admission in Deemed to be Universities.

    Now question arises regarding the following universities (which were running engineering as well as other degree courses through distance education mode). The degrees in Engineering stream (B.Tech/BE, MTech/ME, Engineeing Diploma) were offered by means of study centres throughout the country.

    1. JRN Rajasthan Deemed University Udaipur

    2. IASE Deemed University, Sardarshahr

    3. Vinayak Mission University Salem

    4. Allahabad Agricultural University, Allahabad

    1. Was the committee, aware about the fact that these Universities were offering Engineering Programmes (B.Tech/BE, MTech/ME, Engineeing Diploma or not) before giving post facto approval ?

    2. Is post facto approval applicable to these engineering courses or just to other non engineering degree courses?

    3. Was joint committee at the time of post facto approval aware that engineering courses were running by the above universities by means of private study centres?

    4. Was joint committee aware the exams for engineering degrees were conducted under the supervision of study centers only?

    5. With regard to question 4, if yes, has the joint committee verified the standard of Question Papers for BTech and M.Tech of all the four universities before giving approval?

    5. With regard to question 2, If yes (for engineering courses), have they got the AICTE approval or not?

    6. As AICTE Nominee was there in the joint committee meeting, as per his knowledge these Universities(with degrees through study centres) have got the AICTE approval or not?

    As per the information provided by the DEC, some universities like JRN and IASE Deemed Universities got the provisional recognition to offer programmes through distance mode for one academic year 2007-08, for programmes approved by the statutory bodies of the University. But for the Engineering Programmes they need separate approval from the AICTE, as per the Gazette Notification 44 and as per the information provided by the DEC.

    Now point 1(DEC version) and point 2 (AICTE policy) are contradicting each other. Which one of these two is correct?

    Honorable Delhi high court has disapproved the degrees acquired by Mr. S.C Jain and others while applying for promotions in Ministry of Broadcasting, Union of India. The point here to be noted is that Mr. Jain and others got admission in the degree course in the year 2003 in IASE university (the period for which post facto recognition is given) and were pursuing the degree through study centres at New Delhi and Rohtak.

    ‘Agriculture superintending engineer produced fake certificate to get promotion’

    HYDERABAD: A probe by the vigilance and enforcement department has established that the B Tech degree certificate produced by a senior engineer in the agriculture and marketing department in order to get promoted to the rank of superintending engineer (SE) was fake.

    K Radhakrishna Murthy was promoted to his present rank based on a B Tech (Civil) degree in August 2009. Later, a complaint received by the department stated that the degree, which he secured in 2006 from Institute of Advanced Studies in Education (IASE), a deemed university of Rajasthan, was fake and not valid.

    The then marketing commissioner referred the matter to AP Lokayukta. A thorough probe was also ordered by vigilance and enforcement officials to check if Radhakrishna Murthy misled the government. As per rules, to get promoted to the rank of SE, a candidate must have a BE degree from any recognised university under Central Act or State Act. Murthy produced a B Tech degree from IASE through distance mode. Without verifying the the certificate, the department promoted him to the SE rank.

    Later, the vigilance department got the certificate verified by UGC, Distance Education Council of India and AICTE. The UGC informed the AP State Council of Higher Education (APSCHE) that IASE was not granted approval to run the B Tech course through distance mode. The Distance Education Council of India, New Delhi, confirmed it. AICTE made it clear that it had not accorded any permission to IASE to run engineering courses in distance mode.

    The vigilance inquiry report (No.15(438/V&E/E1/2010-HYD City-II) said that the certificate produced by Murthy was not valid as the institute was not approved by the UGC, DEC and AICTE. The report observed that Murthy had misled the screening committee by knowingly suppressing the facts regarding the validity of his degree.

    Now, the department of agriculture marketing and cooperation had issued a memo to the SE to produce his original certificate for verification. If he fails to do so, he may be demoted.

      Whether you are the right persion or UGC is the Appropriate Authority Regarding Ex-Post Facto Approval.Please See the Attachetment with underline in the letter regarding One Time Ex Post Facto Approval for Courses in favour of the innocent student of the JRN Rajasthan Vidyapeeth University under Distance Mode.This had been approved by The Chairman of UGC as per Recomendation of the constitute comittee of UGC.After that Joint Comittee of UGC-AICTE-DEC granted one time Post Facto apporval for the courses (That were approved by the Statutory Body of the University)in the Third meeting of the Joint comittee of UGC-AICTE-DEC. and DEC granted one time post facto apporval based on the Recomendation of the comittee in the point No 3 of The third mitting of Joint Comittee which are given below.

      DEC issued a letter based on the Recomendation of Joint Comittee.
      as per Letter No. DEC/JRN/RJ/06/5448 Dt.29-8-2007 which attached ealier and also attached herewith.
      Also attached Minutes of The Meeting for the Examination of Proposal for Ex Post Facto Approval by DEC (Dated 1.08.2007 and 2.08.2007)and UGC to DEC Communication Letter Regarding Ex-Post Facto Approval Dated. 16 April 2007 Letter No. F-6-1(6)/2000(CPP_-1) attached herewith that Ex-Post Approval had been granted through Proper Channel and it had taken two(2) years for approval for JRN Rajasthan Vidyappeeth University.
      What is your opinion regarding Ex-Post Facto Approval had been granted through proper channel or not ?

    1. The petitioner is technical consultant of Janardhan Rai Nagar Rajasthan Vidyapeeth University, Pratap Nagar, Udaipur, Rajasthan (deemed University) (hereinafter referred to as “the University” for short) and had opened a study centre under an MOU with the University under Distance Learning Programme (DLP) in the name of Indian Institute of Aeronautics at Western Punjabi Bagh, New Delhi. The petitioner was offering B.Tech Degree on Aeronautical Engineering under DLP of the University. Some parents of the students of this institute lodged an FIR with DCP, Economic Offences Wing and alleged that till September 2004, study was going on well in the institute but on 1st September 2005, they learnt about a letter no.F.68/2004(CPP-1) dated 23rd August 2005 that the institute has not taken approval of awarding B.Tech degrees from UGC so the students obtaining degree will not be eligible for higher studies

    on the basis of degrees of the institute. It was mentioned in the FIR that the complainant showed the said letter of University Grants Commission (UGC) to the authorities of the institute and the authorities of the institute assured that the approval was obtained by the institute and in no way the future of the students would be hampered. However, when on 20th September 2005, four students went to Distance Education Council (DEC) and UGC to find out if the assurance given by the institute was correct or not, their enquiry from DEC and UGC revealed that the degrees of the institute and the university were not approved either by DEC or by UGC. It was alleged that after learning this fact, all the students left the institute, some took admission in other colleges in the first semester and some had to leave the studies but in spite of that this institute was giving admission to fresh students. In view of this, it was requested that action should be taken against the institute so that the institute was not be able to play with the future of other students by giving admission without obtaining approval /permission from the appropriate authority. It was also submitted that the institute had been charging a sum of Rs.3 lac for the said course from each student and it was prayed that action under Section 420, 406 and 120B IPC be taken against the institute. Copies of prospectus, UGC letter and the complaint made by the complainant to different authorities were attached with the complaint.
    2. The petitioner has sought quashing of this FIR on the ground that a circular dated 9th August, 2005 issued by UGC gave misleading information to students, DEC also gave confusing and misleading information. The petitioner and other affected institutes thereafter filed writ petitions before different High Courts and operation of the Circular of UGC was stayed by different High Courts. In Delhi High Court, UGC made a statement that the impugned circular had been withdrawn. It is also submitted that ex post facto approval was given to the course being run by the institute by DEC and UGC and the impugned FIR was registered on a misleading circular which created fear and panic

    amongst the students. 3. It is not in dispute that petitioner’s institute was an off campus centre and was opened under the permission of the University. The institute was awarded provisional authorization by the University on 10th December 2003. The students of the University had made inquiries from UGC about the recognition of the course of B-Tech being conducted by the University from various institutes and UGC vide its letter dated 29th July, 2004 had written to one of the students as under: “With reference to your letter dated 2.6.2004 on the above subject, I am directed to inform you that B-Tech Aeronautical Engg is a recognized course and Rajasthan Vidyapeeth is also a recognized Deemed University under Section 3 of the UGC Act.”
    4. UGC’s letter / circular dated 9th August 2005 was the cause of panic amongst the students. UGC had written letter to the institutes in March, 2004 that it had come to its notice that some of the Deemed Universities were not functioning as per well-defined objects and were introducing new courses/study centres off campus without taking any approval from UGC. At times, these centres were opened without proper physical and academic infrastructure. UGC cautioned Deemed Universities that they have to obtain prior approval of UGC before starting a new course or for opening an academic centre/study centre. UGC had also laid down guidelines for opening study centres for Deemed Universities. In light of this letter, UGC had issued the circular/ notice dated 9th August 2005 and in this notice/ circular name of Janardhan Rai Nagar Rajasthan Vidyapeeth University, Pratap Nagar, Udaipur, Rajasthan, Allahabad Agricultural Institute, Institute of Advance Studies Education, Gandhi Vidyamandir, Sardarshahr. UGS figured. It was stated in the circular that these Deemed Universities have not been permitted to affiliate any college/ institute and these institutes have not been allowed to

    conduct any course through Distance Education Centre and the students of these institutes were advised to keep these things in mind while getting admission in these Deemed Universities. It was notified that no deemed University can start study centre/franchisee without approval of UGC and the State Government. 5. It is this circular which resulted into registration of present FIR. This circular was assailed by the petitioner before Delhi High Court. After issuance of this circular, the abovementioned deemed universities approached UGC for ex post facto approval of the course for the students admitted in the B. Tech. course under Distance Education Mode from 1st June, 2001 to 31st August 2005. Vide letter dated 3rd July 2006, UGC informed the abovementioned deemed universities that a committee constituted by UGC had considered the request of the deemed universities for ex post facto approval of the courses being run by the deemed universities through Distance Education Mode (including the course being run by the petitioner) and the committee recommended one-time ex post facto approval for the students admitted under Distance Education Mode by the above deemed universities from 1st June, 2001 to 31st August 2005, subject to compliance of certain conditions which were mentioned in the letter. After that, the abovesaid deemed universities wrote a thanks letter to UGC and assured for compliance of all conditions. The writ petition filed by the petitioner for challenging the virus of the notification was continued before this Court and vide order dated 22nd May, 2008, this Court observed that UGC had filed notification dated 15th May, 2008 and UGC in that notification has averred that the circular dated 9th August 2005 and 23rd August 2005 stands withdrawn with effect from 5th November 2007. Directions were given to UGC to rectify its website where the circular still continued to be shown. The DEC also confirmed that the circulars dated 23rd August, 2005, 9th August 2005 and 5th January 2006 stand withdrawn. In view of this stand of UGC and DEC of having withdrawn the circulars, the petition was disposed of.

    6. It is obvious from the entire documents placed by the petitioner on record that the deemed university of which the petitioner was the technical consultant had approved opening of the DLC and the Distance Learning Centre opened by the petitioner was in fact a distance learning centre of the university. A course being run in the institute was approved by the university prior to 2004 and no specific approval of the course was needed from UGC. It is only in 2004 that UGC observed that certain universities were opening distance learning centre without proper paraphernalia. However, UGC in 2004 did not direct the university to stop its distance learning centre including the centre of the petitioner. In 2005, notifications were issued about the university and its courses. However, after issuance of notification ex post facto approval of the course wherein students had already taken admission between 2001 and 2005 was granted and later on the circular itself was withdrawn. From these facts, it is clear that the FIR registered on the basis of circular of UGC had no substance left in it as the circular was under challenge and ultimately was withdrawn. 7. I, therefore, allow this petition. The FIR No.337 of 2006 dated 24th April 2006 registered with police station Punjabi Bagh, New Delhi under sections 406,420 read with Section 120B IPC and the proceedings emanating therefrom are hereby quashed. 8.     In the Ex-Post Facto Recognition and Provitional Recognition , It had not mentioned that in the communication letter that Professional/ Technical programme should not offer.It had mention it in the letter send by DEC on 2011.All communication letter from UGC to DEC and DEC minutes of meeting held on 1.8.2007 and 2.8.2007 with recomendation are attached herewith.and also attached the MHRD Notification,dt 7th April 2006 and AICTE letter 20 November 2006 are attached herewith.

    IGNOU Conducted B. Tech (Civil & Mechanical ), that Degree are Valid or Not ?
    and IGNOU had stop Admission from January 2009 of the above course.Those who have got permission for there respective authority for furthe study of JRN Rajasthan Vidyapeeth Univerity as well as IGNOU, that Degree had already been accepted by the respective Department after comlitation of the course. UAE Embassy of India Stamp and accept the Degree of JRN Rajasthan Vidyapeeth Deemed University for Education as well as Job also for DIPLOMA AND B. Tech .

      Am I right or not it is not the question which matters. I had just presented the facts as given by law of land (the delhi high court). One more thing I want to say is that this judgement is latest one 23 December 2011, compared to the one you are referring. Various other judgements which were in favour as well as against technical courses through distance education had been discussed in this judgement. And those in favour of technical courses through distance education have been over ruled. Honorable Supreme Court is also of same view which is also taken into consideration while giving decision in this judgement. The ex post facto approval for distance education for technical courses has been rejected. The documents you are showing, everyone is aware about the same, there’s nothing new, and its but obvious that these documents must had been presented in the court while this court hearing was going on. Also nominees (advocates) from all the three parties i.e. UGC-AICTE-DEC were present, please check there views.
      Also the news of “Agriculture superintending engineer produced fake certificate to get promotion” dated June 24,2012 in Times News Network states that “vigilance department got the certificate verified by UGC, Distance Education Council of India and AICTE. The UGC informed the AP State Council of Higher Education (APSCHE) that IASE was not granted approval to run the B Tech course through distance mode. The Distance Education Council of India, New Delhi, confirmed it. AICTE made it clear that it had not accorded any permission to IASE to run engineering courses in distance mode.”
      I am just referring what the authorities are saying in the court. If you are not satisfied with the views mentioned in this judgement by the representatives of UGC/AICTE/DEC as well as the vigilance report, you can file an RTI to these authorities alongwith this judgement and enquire the same to bring what is true.

        kindly tell me whether my degree Btech civil started in 1997 and completed in 2001 from ignou is valid ornot. this degree has been accepted in DDA , JAL BOARD , DESU , DELHI METRO . But our department is creating problem . None of the cort cases discussed about IGNOU . can u put some light . Pls help

    Plaintiff Jaibir Singh Goyat, having remained unsuccessful in both the courts below in securing temporary injunction, has knocked the door of this Court by way of instant revision petition under Article 227 of the Constitution of India.

    Plaintiff was appointed as permanent Electrician in defendant no.1 Sugar Mills vide letter dated 20.09.1995. He was promoted as Electrical Foreman vide letter dated 15.10.1996. The plaintiff claims that he holds diploma in Electrical Engineering with 71% marks from J. R. N. Rajasthan Vidya Peeth University, Rajasthan (in short Rajasthan Vidya C. R. No. 7055 of 2009 2

    Peeth) through distance mode, duly approved by University Grants Commission (UGC) and Distance Education Council (DEC). He also possessed other qualifications for promotion to the post of Assistant Engineer (Electrical). He is also looking after the work of the said post. Jarnail Singh Draftsman, having passed Mechanical Engineering from the same University, has been promoted as Assistant Engineer. However, the defendants have issued advertisement for direct recruitment to the post of Assistant Engineer (Electrical), although direct recruitment can be resorted to, only if no suitable candidate is available for promotion to the said post. The plaintiff being eligible for promotion to the said post, the defendants cannot resort to direct recruitment. The plaintiff sought temporary injunction restraining the defendants from filling up one post of Assistant Engineer (Electrical), out of the three advertised posts. Defendants, while admitting the factual position, inter alia pleaded that the diploma obtained by plaintiff from deemed University i.e. Rajasthan Vidya Peeth has not been approved by All India Council for Technical Education (in short AICTE), as intimated by Director, Technical Education, Haryana and therefore, the plaintiff is not eligible for promotion to the post of Assistant Engineer (Electrical). Learned Civil Judge (Junior Division), Rohtak, vide impugned order dated 11.08.2009 (Annexure P-2), upheld the aforesaid plea of defendants and dismissed the plaintiff’s application for temporary injunction. Appeal preferred by the plaintiff against the said order has been dismissed by learned Additional District Judge, Rohtak, vide order dated 06.10.2009 (Annexure P-1). Feeling aggrieved, the plaintiff has preferred the instant revision petition.

    I have heard learned counsel for the parties and perused the case file.

    Learned counsel for the petitioner contended that as per minutes of third meeting of the Joint Committee of UGC, AICTE and DEC, C. R. No. 7055 of 2009 3

    held on 07.08.2007 (Annexure P-14), recognition was granted to Rajasthan Vidya Peeth up to the academic year 2007-08, whereas the petitioner passed the qualifying examination of diploma from the said Vidya Peeth in examination held in January 2007 and therefore, the diploma obtained by the petitioner from the said Vidya Peeth is duly recognized by AICTE as well.

    Learned counsel for the petitioner next contended that Jarnail Singh, having obtained diploma in Mechanical Engineering from the same Vidya Peeth, has been granted promotion.

    Learned counsel for the petitioner also contended that in view of Section 10(1)(k) of the AICTE Act, read with Section 2 (4) in Section 23 of the said Act, running/conducting of courses and programmes in technology courses by University does not require prior approval of AICTE because definition of `Technical institution’ under AICTE Act does not include University, as held by Hon’ble Supreme Court in the case of Bharathidasan University and another vs. All India Council for Technical Education and others reported as AIR 2001 Supreme Court 2861. It is contended that Rajasthan Vidya Peeth is a deemed University established under Section 3 of the UGC Act, 1956, vide notification no.F.9- 5/84-U-3 dated 12.01.1987 of the Government of India. On the other hand, learned counsel for the respondents contended that as per intimation given by Director, Technical Education (Haryana), diploma course of Rajasthan Vidya Peeth has not been recognized by AICTE.

    I have carefully considered the rival contentions. Ipse dixit of Director, Technical Education (Haryana) that diploma course of Rajasthan Vidya Peeth is not recognized by AICTE cannot be said to be final word on the subject. On the other hand, the said course has been recognized by UGC, AICTE and DEC in meeting of Joint Committee held on 07.08.2007. It would prima facie depict that diploma C. R. No. 7055 of 2009 4

    course of Rajasthan Vidya Peeth up to academic year 2007-08 stands recognized by AICTE and the petitioner passed diploma from Rajasthan Vidya Peeth in the year 2007. Consequently, prima facie, the diploma held by the plaintiff, cannot be discarded or ignored to determine his eligibility for the post of Assistant Engineer (Electrical). In addition to the aforesaid, since Rajasthan Vidya Peeth is a deemed University established under Section 3 of the UGC Act, 1956, vide notification dated 12.01.1987 of the Government of India, as mentioned in the Marks’ Statement Annexure P-7 issued by Rajasthan Vidya Peeth, prior approval of AICTE, for running course in technology by the said University, is not required in view of judgment of Hon’ble Supreme Court in the case of Bharathidasan University (supra). Jarnail Singh, holding diploma from the same University i.e. Rajasthan Vidya Peeth (at page 72 of the paper-book, being part of Annexure P-16), has been promoted vide order Annexure P-16, holding him to be eligible. In view thereof also, the plaintiff cannot prima facie be held ineligible on the ground that the diploma obtained by him from Rajasthan Vidya Peeth is not recognized one.

    For the reasons recorded herein above, I find that the plaintiff has made out a prima facie case that he is eligible for promotion to the post of Assistant Engineer (Electrical). Balance of convenience is, therefore, in favour of the petitioner and obviously, he would suffer irreparable loss and injury if temporary injunction asked for is not granted. In view of the aforesaid, the instant revision petition is allowed and impugned orders i.e. order dated 11.08.2009 (Annexure P-2), passed by the trial court and order dated 06.10.2009 (Annexure P-1), passed by the appellate court, are set aside and application for temporary injunction moved by the plaintiff-petitioner is allowed and defendants are restrained from filling up one of the three posts of Assistant Engineer (Electrical), advertised by the defendants, till the final disposal of the suit. It is C. R. No. 7055 of 2009 5

    expressly made clear that nothing observed herein above shall be construed as an expression of opinion on the merits of the suit. The trial court is directed to decide the suit expeditiously.

    I want to ask you a simple question; can JRN Rajasthan Vidyapeeth take new admission in 2012 for their Engineering programmes under Distance Education? This University is still taking new Engineering admission under distance education through their study centers. Whatever facts you produced here, maximum of them were known to us. In their advertisements they claim that University & their Distance Education programmes are recognised/approved by MHRD, UGC, DEC to manipulate innocent mind of students & at the same time when these Apex bodies try to check their greediness or try to stop their cheating against students, they go to court & litigate the matter. Now question is who suffers. Answer is innocent students. They charge Lakhs of rupees from students in the name of UGC,MHRD,DEC recognized/approved Distance Education programmes & after wasting golden period of their student life when they receive certificates then they realize that there is no value of these certificates because The same UGC,MHRD,DEC don’t recognize these certificates. Now tell me Mr. Atanu_rahut , what students should do?

I Furthe said that I, WE always Recognised MHRD Letter No. –DO No. 6-72009/DL dt. 29 July 2009 that B.E/ B. Tech under distance mode of any UGC Recognised University are valid untill admission of August 2009.
    At Present JRN Rajasthan Vidyapeeth University got Regular Recogoction/course wise or Programme wiseRecognition by DEC and University had not any authority for admission B. E/ B. Tech under distance Mode.Ii had already mention in my previous post and the matter is under sub judice.Student are advice not to take admission of any UGC university of B.E/ B. Tech under distance mode till the dicission come from Supreme court. and Student are requested/advice to collet Recent(Year-2012) Approvel Letter by DEC when you have taken admission into study centre of the above or any UGC recognised university under distance mode due to Expart Comittee already submited Recogmendation and DEC already issue Course Wise programme wise Regular Recognition of above University. so, Provitional recognition and Continuation of Provitional Recognition had not Valid at present, only valid Course wise / Programme wise Regular Recognition.

      They are denying me promotion based on this MHRD letter dated 29th July 2009 supported with their own logic that no Btech degree from distance education is valid from the beginning.They are even supporting their claims by citing the examples of all those court cases where private / deemed university degree has lost the case even when completed before 2007 also. They are not considering the fact that Btech done from ignou has never been referred to any court and not even challenged by any government body. I am shattered now.     IGNOU granted Post facto Recognition FROM DEC Till 2008 .An AICTE Public Notice dt. 17-4-2007 Show that Programme of Study under Distance mode require from approval of the DEC. Show your B. Tech are the DEC approved programme. Public Notice are changed from time to time. AICTE been set up by Act of Prlament on 1987. Before 1987 Engineering degree are Valid or Not. your Degree are Valid and you may check up Stampting your Degree from MHRD with nominal charges that you want to go outside of India for Job. If MHRD Stamp your Degree i.e accepting your Degree by MHRD so it is not only valid in india but also it is valid for Whole World. For know stampting your degree please go through MHRD Website.AICTE Public Notice are attached Herewith, Please reply.

      The public notice F.No. 37-3/Legal/AICTE/2007 dated 17-04-20007 to which you are referring is wrongly interpreted by you. In the 3rd paragraphs 5th line it meant that engineering + other courses mentioned in the notice have not been approved by appropriate statutory council for being conducted in distance mode. And the reference to DEC in 7th line is regarding courses which can run under distance mode.

      The members were informed of the recent letter issued by MHRD dt 29.07.2009 regarding withdrawal of permission given to Institutions to conduct B. Tech/B.E. Programmes through distance mode and also stop admissions to such programmes from the current year onwards. In this connection, it was noted that the Joint Committee of UGC-AICTE-DEC has not given recognition for any B.Tech/BE programme. The DEC has specifically insisted that any programme requiring approval from Statutory Councils like AICTE should be initiated, only after getting such recognitions.

    IGNOU had started Engg. Pragrammes through collaboration with some private educational Trust. Earlier they used to offer these programmes only through AICTE approved Engg. colleges but latter to get more business that trust started authorizing small coaching classes/institutes as study/learning centers to offer Engg. programmes without verifying whether do they have infrastructure to arrange practical/ workshops/labs or adequate class room facility for contact programmes. Just imagine Engineers holding Engg. certificate from a reputed Govt. University having ZERO knowledge of practical and theories in their respective Engg. field. Now problem is if MHRD or other authority approves IGNOU Engg. Certificates then other University will go to Court & will demand same approval for their Distance Education Engg. Certificates.

      my dear ASs per my knowledge and information IGNOU never started or conducted engineering programmes with any private educational trust. Do not quote wrong information here . I strongly object.. .There is hell out of difference in the way ignou conducted engg courses than others conducted. Morever if u go through whole court cases in deatils regarding deemed university loosing out the claim.. u will observe there were many many points over which court gave verdict against these universities small eg.. giving franchising.. no standard course material, prior warnings from DEC, Raids etc. Nothing is similar with ignou.. Got it..

          The things u are talking about happened through DEC (IGNOU) for giving recognition to Deemed University and then these university created havoc through franchising and distributing degrees like sweets and created the problem for genuine people. These degrees through private universities were not distributed in the name of IGNOU. Go and check the whole story again . You dont know any thing just creating confusion here ..

          IGNOU Conduct both Engineering Programme By Colaborative as well as distance mode and Distance mode programme in Engineering i.e CIVIL AND MECHANICAL stop form January 2010 as per MHRD Direction.And Colaborative Programme Jast Like JRN Rajasthan Vidyapeeth University through Private Franchise and Colaborative Programme been stop from 2011.
          The Class conducted by Franchise and Classes would continue on Saturday and Sunday but IGNOU established that it is full time programme as also mention above website also.SO, all franchise Programme are same it may be IGNOU and also be JRN Rajasthan Vidyapeeth University.     I have passed B.Tech.(CSE) from JRN Rajasthan Vidypeeth University,Udaipur in the year 2010. After reading this post i thought that my degree was not valid. I just wasted my time. I am so tensed. Before taking admission i searched a lot but at that time this university was valid and not having any complaint. In the year 2009-2010 this university was blacklisted than govt said no student will suffer. In all this conversation no one can think about the student who had passed from this university. Is this our fault.

    I want to clarify that if U go for legality it is mandatory to get approval of DEC & AICTE for technical courses offered through distance mode as per MHRD notification 1995. while granting deemed university status MHRD stated that this recognition is subject to condition that they(deemed university) should adhere to conditions prescribed by UGC from time to time. they not followed the conditions of UGC with regard to establishment of study centers, and hence degrees/diplomas awarded through study centers of deemed universities are not valid. with regard to sufferings I most of them joined are government employees who want to get in service promotions by virtue of this degree at cost of genuine degree holders. there are instances of getting these degrees with in a span of 1 or 2 years, by writing 48 subjects. We have already seen the case of agriculture Engineer in AP & there are about 500 cases in AP ADMINISTRATIVE TRIBUNAL & HON`BLE AP HIGH COURT. An enquiry by CBI under supervision of Hon`ble Court is need to be taken upto punish the guilty and to curb such activity in future, further to save education system in country.

    I appriciate your thought.The purpose of this forum is to expose these Universities.That we did.Now to punish or teach them proper lesson is in the hands of either Apex bodies like UGC,MHRD,AICTE,DEC or the students who have suffered.These Apex bodies time to time have published public notices to warn students & their parents,not to take admission in these Universities because their Engineering Certificates under distance education are not valid.I am not saying that these are sufficient,they must take more effective action because marketing network of these Universities are so good that innocent students fell into their trap.You all know that DEC has taken steps against them & even threatened them to derecognise their University status but these Universities know the loop holes of system & they approached High Court & litigate the matter & we all know legal matter takes time in our country.That’s why I through this forum have requested several times to students to approach Consumer Court.There you will get justice & you will get back your fees with interest including Court expences.The best way to teach them lesson is to strike on their finanacial transaction.Root cause of this corruption is to earn huge money by cheating students & striking on that will definitely bring something positive for students.

    Sir, kindly give me straight opinion. Btech through IGNOU , A university formed through statue i.e parliament act , Under Ministry of HRD ,Govt of India is valid or not .. I took admission in 1997 and completed in 2001. In recent judgement of double bench , chandigarh high court on 6 th Nov 2012 court gave verdict against four deemed universities . The court recorded that Deemed University are not University and Aicte approval is must for them but not for University like IGNOU.

    The reply given DEC in the RTI about JRN Vidyapeeth is contradicting, with the reply by AICTE. In the RTI reply(the document posted by Mr. Param) for Question 1, DEC is agreeing that that for 2007-08 JRN was given approval but the same is being denied by AICTE. I am uploading one the RTI replies (RTI.pdf) which is available at CIC website which proves the same.

    On Nov 6,2012 Punjab Haryana High Court has given decision against the four deemed universities putting question on Post fact approval given by DEC. I also request you to file an RTI titled “ Engineering courses through distance education clarification” to AICTE to bring the truth of Post facto approval. Check the file court case uploaded here.

    I wish to add that honorable justice Mansoor Ahmad Mir,judge J&K high court delivered his judgement on 6-6-2012 in OWP NO :674/2010 and group of cases.critically reviewed the stand taken by the UGC,DEC and J&K govt and uphold that degrees offered by deemed universities through distance mode are not valid.in this case the main culprit is PRIST university Tamil Nadu(deemed university).in addition to declaring the degrees awarded by the deemed universities as invalid,his lordship directed the chief secretary to examine the entire case and see how and where these unauthorized centers (study centers of deemed universities)are being run.it was further directed to leave no stone un turned to unearth the conspiracy and fix the responsibility accordingly. Chief secretary was asked to go for registration of a criminal case if required and monitor its investigation.it was further observed that “given the fact that it relates to future of our nation ,the Chief secretary may bear in mind and the sensitivity of the matter , while taking up the task in his hands” The same spirit is to be carried out to the APEX court level, and punishments need to be awarded to the culprits in the entire episode.

    arises was before this Hon’ble Court in W.P.(C) No. 15829 of 2008 aw* W.P.(C) No.3524 of 2009 /*- me still pending as per instruction received.
    The Hon’ble Mr.V.Gopala Gowda, B.Sc. LL.B., the Chief Justice of Orissa High Court and His Lordships Companion Justices of the said Hon’ble Court.
    The humble petition of the
    Petitioner, named above:
    Most Respectfully Sheweth;
    1. That the petitioner, who is at present working as Line Man under opposite party No.2,3 and 4 files this writ application
    challenging the action of the opposite parties particularly opposite party No.4 in rejecting the application of the petitioner
    for the post of Graduate Engineer Trainee (GET) pursuant to the advertisement made in “The Samaj” as well as in “the New
    Indian Express” dated 10.06.2011 solely on the ground that the petitioner submitted a degree qualification of Electrical
    Engineering obtained from a University which is not recognised.
    >
    The grievance of the petitioner is that though the petitioner has obtained such degree from Deemed University
    which has already been approved by the competent authority
    namely DEC, AICTE & UGC in their joint meeting. The action of the opposite parties in not accepting the degree of the
    petitioner for the above purpose is not only arbitrary, but also without any authority of law.
    2. That the petitioner is a resident of Damodarpur, B.C. Dutta Lane, P.O.: Motiganjin the district of Balasore and the
    cause of action for filing the present writ application arises within the territorial jurisdiction of this Hon’ble Court.
    3. That the Northern Electricity Supply Company (hereinafter referred to NESCO, Western Electricity Supply
    Company (hereinafter referred to WESCO) and Southern Electricity Supply Company (herein-after referred to SESCO}, of Orissa Ltd. are State within the meaning of Article-12 of the
    Constitution of India, as the State Government has evasive control over the aforementioned organizations.
    4. That the petitioner was duly selected by the opposite parties for appointment as Trainee Technician and pursuant to the appointment letter, the petitioner submitted his joining report on 04.10.2004. While the petitioner was appointed,
    he had the requisite qualification for the above post that is ITI in
    Electrical Trade which was the requisite qualification for appointment of Trainee Technician.
    5. That while the petitioner was continuing as a Trainee Technician, his appointment was confirmed against the post of Junior Technician. While continuing as such, the petitioner moved the opposite parties to go for higher study under a Deemed University namely J.R.N.Rajasthan Vidyapeeth
    (Deemed University).
    6. That while the petitioner was continuing as Junior Manager, he had acquired Diploma from JRN Rajasthan Vidyapeeth University (Deemed University) and subsequently he
    had also acquired B.Tech. qualification in Electrical. It is not out of place to mention here that JRN Rajasthan Vidyapeeth
    (Deemed University) is a university declared to be deemed university under section 3 of U.G.C.Act, 1956 and notified by Government of India, Ministry of Human Resources Development Department. Copy of such Notification dated 12.01.1987 is
    annexed herewith as Annexue-1.
    7. That so far as the recognition of courses conducted by the said JRN Rajasthan Vidyapeeth University, the
    Government of India in its letter dated 17.02.2004 has clearly stated that all the degrees/diploma awarded by the above University established by a Act of Parliament under section 3 of
    the UGC At stands automatically recognized for the purpose of employment under the Central Government, no formal order
    recognizing such degree/diploma are necessary to be issued.
    The copy of such order of the Government of India dated 17.02.2004 addressed to the Vice Chancellor of JRN Rajasthan
    Vidyapeeth University is annexed herewith as Annexure-2.
    8. That the petitioner had undergone the Diploma course i.e. the Diploma in Electrical Engineering through Distant
    Education Mode under JRN Rajasthan Vidyapeeth University,and acquired B.Tech. qualification in Electrical during 2005 to
    2010. After successfully undergoing the aforesaid courses the petitioner appeared the examination and declared to have
    acquired both Diploma and Degree from the aforesaid Deemed University. The copy of such Diploma certificate as well as the
    Degree awarded to the petitioner are annexed herewith as Annexures-3 and 4 respectively.
    9. That while the petitioner was continuing as Junior Technician, the opposite party Nos. 2 to 4 decided to fill up the
    vacancy for the post of Diploma Engineer Trainee in short (DET) and Graduate Engineer Trainee (GET) by giving promotion to the
    Junior Technicians who have the diploma qualification in Electrical Engineering. Accordingly necessary applications were
    invited from the available Junior Technicians for such promotion
    for the post of DET and GET. The petitioner, who had the requisite qualification and experience, offered his candidature before the Chief Executive Officer for consideration of promotion to the
    post of DET and GET respectively. After receipt of the application
    along with required certificates, the Chief Executive Officer
    forwarded the same to the Managing Director and after
    thorough scrutiny the Chief Executive Officer found that the
    petitioner has satisfied the eligibility criteria for promotion to the
    post of DET and GET. Accordingly the petitioner was called to
    the interview which was held on 04.05.2008 and 16.08.2008
    respectively for filling up the vacancies for the post of DET and
    GET. The petitioner participated in the said interview and his
    performance in the said interview was also quite good. The
    petitioner was asked to submit the original diploma and degree
    certificate issued to him by the Deemed University for
    verification. ::„…”"
    10. That thereafter when the appointment letters were
    issued to other candidates, who had applied along with the
    petitioner having the same qualification of diploma and degree
    from other Universities and they were given promotion to the
    post of DET and GET, but no promotion order was issued to the
    petitioner and after waiting for sometime the petitioner moved
    this Hon’ble Court along with some other similarly situated
    candidates in a writ application bearing W.P.(C) No.15829 of
    2008 with a prayer to direct the opposite parties to treat the
    diploma and degree i.e. granted by JRN Rajasthan Vidyapeeth

    University is valid for all purposes and further prayed that the
    opposite parties be directed to publish the result of the interview
    for promotion to the post of DET and GET held on 04.05.2008 and
    16.08.2008 and sought for a direction to the opposite parties to
    give promotion to the petitioner to the higher post of DET and
    GET within a reasonable time.
    11. That the aforesaid writ application filed by the
    petitioner along with others were taken up along with similar
    identical matters filed by some of the employees of MCL who
    had also obtained the diploma and degree from the same
    university i.e. JRN Rajasthan Vidyapeeth University, and a Division
    Bench of this Hon’ble Court disposed of both the writ
    applications by passing similar orders, wherein a direction was
    made to the opposite parties to constitute a committee
    consisting of the representative of UGC, AICTE and DEC and
    Director of DEC as Chairman and one of the officer of the
    Management of MCL. This Hon’ble Court further directed that
    after forming such High Level Committee, such committee will
    enquire into the matter in order to find out if the certificates
    issued are genuine and acceptable and if that is so the opposite
    parties shall proceed with the matter in accordance with law.
    The petitioner reserves his right to refer to the said order dated
    16.04.2009 passed by this Hon’ble Court in the previous writ
    application.

    12. That accordingly in terms of the direction of this
    Hon’ble Court dated 16.04.2009, a High Power Committee was
    constituted with the representatives of AlCTE, DEC and UGC
    under the Chairmanship of Director, D.E.C. to enquire into the
    matter. One of the Officers of the MCL was also present. In the
    said High Power Committee, it was concluded that the DEC has
    given institutional recognition to JRN Rajasthan Vidyapeeth
    University, for offering the programme approved by the statutory
    body of the University through Distant mode. It was further
    decided that the recognition given by the DEC to the
    degree/diploma students is given under post facto recognition,
    regular recognition to its institution and its programme will be
    given finally on the recommendation/decision of the joint
    committee (UGC, AlCTE and DEC) as decided in the last
    meeting of the joint committee. Copy of such minutes of the
    meeting of higher power committee dated 04.06.2009 is
    annexed herewith as Annexure-,^*
    13. That in the meantime some of the employees of the
    MCL as well as some of the employees of NESCO had also
    moved this Hon’ble Court in writ application bearing W.P.(C)
    No.3524 of 2009 and W.P.(C) No.4202 of 2009 wherein they
    made a prayer to direct the opposite parties to act in terms of
    the recommendation made by the High Power Committee and
    to accept the certificate granted by JRN Rajasthan Vidyapeeth
    University (Deemed University) In the said writ application, this

    Hon’ble Court was pleased to pass interim orders directing the
    opposite parties not to take coercive action against the
    petitioner. It is not out of place to mention here that in W.P.(C)
    No.3524 of 2009,the present petitioner is one of the petitioner
    and the said writ application is still pending where interim
    direction has been granted to the petitioner.
    14. That in the said matter from the counter affidavit
    filed by the UGC and the Distant Education Council it has been
    clearly admitted that the post facto recognition has been
    indeed given to the degree and diploma course imparted by
    the JRN University from 2001 onwards. Copy of such counter filed
    by the DEC in the aforesaid writ application is annexed herewith
    as Annexure-P
    15. That while the matter stood thus, another
    advertisement was made in the daily newspaper “The Samaj” as
    well as “The New Indian Express” on 10.06.2011 inviting
    applications from the eligible candidates for appointment to the
    post of Graduate Engineer Trainee (GET). In the said
    advertisement the eligibility criteria has been fixed that a
    candidate for such post having degree in Electrical Engineering
    with minimum 60% mark can apply for such post. Insofar as the
    present petitioner is concerned, he has acquired a degree
    qualification of Electrical Engineering having more than 70% of
    mark and accordingly he submitted his application Online
    through the official Website of Opposite party Nos. 2 and 3 and

    accordingly the application of the petitioner was duly processed
    and he was assigned with registration No. (ID No.
    GET00101020110623). Copy of the said advertisement dated
    10.06.2011 as well as the application with assigned Registration
    No. to the petitioner by the opposite parties is annexed herewith
    as Annexure-y//; Ai*£~?h*
    16. That it is now understood that though the petitioner’s
    application was processed and the registration No. was
    assigned to him, but subsequently only on the ground that the
    degree qualification of Electrical Engineering of the petitioner
    obtained from deemed University cannot be accepted since
    the University is not a recognized one. The petitioner has met the
    opposite parties and had also brought to the notice of the
    authorities regarding the decision of the High Power Committee
    with respect to the grant of post facto recognition to their
    degree and diploma courses pursuant to the direction of this
    Hon’ble Court in the earlier writ application, but the opposite
    parties took a plea that since the certificate had not been
    obtained from a recognized University the same will not be
    acceptable. It is respectfully submitted that such action of the
    opposite parties in not accepting the qualification of the
    petitioner i.e. degree in Electrical Engineering from the Deemed
    University i.e.from JRN Rajasthan Vidyapeeth University, Deemed
    University is not only arbitrary, but also invalid in the eye of law. It
    is respectfully submitted that JRN Rajasthan Vidyapeeth

    University, has been declared as a Deemed University under
    section 3 of the University Grant Commission Act and the Central
    Government has also declared that the certificate granted by
    such University both degree and diploma is to be recognized for
    all service purposes of the Central Government. Moreover, since
    High Power Committee Constituted by this Hon’ble Court with
    the representatives of the statutory body like AlCTE, DEC and
    UGC have decided to grant post facto approval to the JRN
    Rajasthan Vidyapeeth University (Deemed University) and since
    the petitioner had undertaken the course during the relevant
    time which has already been approved post facto by such High
    Power Committee, the certificate granted by the University
    cannot be ignored by the opposite parties on the piea that the
    certificate has not been obtained from a recognized university.
    Thus, it is not only arbitrary but also contrary to the Statute.
    17. That apart from this the petitioner humbly begs to
    submit that so far as the course undertaken by the petitioner is
    concerned, the U.G.C. has also granted post facto approval
    under the Distant Education Mode. The copy of such letter
    dated 13.11.2007 issued by the UGC to the Vice Chancellor JRN
    University is annexed herewith as Annexure-<g
    18. That under the aforesaid circumstances, the action
    of the opposite parties in not considering the candidature of the
    petitioner on the ground that the certificate granted to the
    petitioner is not by a recognized University is totally illegal

    inasmuch as the petitioner has not only produced the certificate
    of Degree Engineering, but he has also produced the mark sheet
    from which it is clear that he has acquired 70% of mark and
    therefore, he has satisfied the requirements as per the
    advertisement to the post of GET.
    19. That the petitioner having no other alternative,
    speedy and efficacious remedy available, forced to file this writ
    application invoking the extraordinary jurisdiction of this Hon'ble
    Court under Articles 226 and 227 of the Constitution of India.
    PRAYER
    It is, therefore, prayed that this Hon'ble Court may
    graciously be pleased to :-
    i) Admit the writ application;
    ii) Call for the records;
    iii) Issue a writ of mandamus or any other
    writ/writs, direction/directions and
    order/orders directing the opposite parties to
    consider the case of the petitioner for
    promotion to the post of Graduate Engineer
    Trainee pursuant to the advertisement dated
    10.06.2011 under Annexure^y/and further
    accept the certificate of degree qualification
    obtained from Deemed University in
    accordance with the post facto

    direct the opposite parties to treat the
    certificate of the petitioner equivalent to the
    degree certificate obtained from other
    statutory University and to consider the
    candidature of the petitioner for promotion

    criteria for the post of Graduate Engineer.
    iv) And/or pass any other order/orders,
    direction/directions as this Hon'ble Court
    deems fit and proper for the ends of justice.

    4. That before giving reply to relevant assertions of the petitioner against
    the present opposite party it is necessary to give a brief description of the
    establishment^ object, background andnetwork of the Indira Gandhi National
    Open University (IGNOU) which will enable this Hon’ble court to appreciate
    the entire scenario ofthe casein its proper perspective.
    5. The IGNOU is a creation of the Parliament It was established in the
    year 1985 with an object to overcome the difficulties generally feced by the
    learners in a conventional university. In a conventional university there is
    rigidity of system requiring attendance in classroom, inflexible curriculum
    and less relevant to the need ofthe learner and so on. The IGNOU provides
    various kinds of educational programmes through distance mode of
    education. Thot^h a diversity ofmeans, including the utilization ofmodern
    communication technology, the distance education can provide more flexible
    and open learning programmes that will suit to the needs of various
    categories oflearners.
    The system ofteaching is unlike the conventional one, and is distance
    mode to meet the continuing needs of the learners. It functions in co
    operation with the existing Universities and Institutions of higher learning
    and make full use of the latest scientific knowledge and new educational
    technology to offer a high quality ofeducation which matches contemporary
    needs.
    6. That for promotion ofdistance education and determination of standard
    of teaching, evaluation and research a Council viz. the Distance Education
    Council (DEC) was established in the year 1991 and was declared by the Act
    as an authority n/s 16(7) of the Act and became Statute 28. This was made by

    Importance stand automatically recognized for the purpose ofemployment to
    posts and services under the Central Govt if such institution has been
    approved by DEC. On such recommendation ofthe Board of Assessment for
    Educational Qualifications, the Central Govt, came up with Notification no.
    44 dated 1.03.1995 circulated to all most all the authorities for information

    1. An institute is granted “Deemed to be University” status based on its
    existing or de-novo programmes. These institutes are required to maintain the
    standard worthy for the Deemed Universities even for the programmes they
    start or introduce after getting the status of ‘deemed to be university’. The
    institute is also required to obtain requisite approvaWpermission from the
    concerned statutory authority for running their programmes including those,
    which are offered through distance mode.
    7.1 The Universities may award degrees to the candidates, who have
    successfully completed their courses including those conducted through
    distance education mode at their own centers in different parts ofthe country
    and not through “Franchise” with the approval of UGC. It cannot be
    construed that a blanketpower had been conferred to the institutions declared
    as deemed to be universities to conduct distance education programmes
    throughout the country in the mariner they wish to do. The Distance
    Education Council was created through a provision in Indira Gandhi National
    Open University (IGNOU) Act, to coordinate and maintain standards of
    distance education.
    8. That it is relevant to state and submit here that in order to fulfill its
    obligations of rramtaining good standard ofeducation, three statutory bodies
    such as UGC, All India Council For Technical Education(AICTE) and DEC
    issued a letter jointly an 13.5.2003 to different Head of Institutions

    cautioning them on the deterioration in standards in education by grant of
    franchise by some Universities. The DEC also individually approached all the
    universities and institutions to submit their distance education programme for
    assessment oftheir quality. Thus all possible efforts were taken in exercise of
    powers conferred on the DEC to maintain standard of education in distance
    mode. A copy of the aforesaid letter dated 13.05.2003 is annexed to this
    counter affidavit a&ANNEXUJRE-D/J.
    9. That under this circumstance, when there is a categorical and specific
    precondition for prior approval of the DEC to run distance education
    programme, without complying the said formalities, as submitted above for
    opening, continuing and awarding certificates by the University using
    distance mode isnull and void.
    9.1 On 17.8.2001 the Registrar of the Deemed University-Opp.Party no.4
    made an application to the Chairman DEC seeking permission to launch
    programmes through distance mode. A reply was given to the said request
    letter by the Director of the DEC on 26.9.2001 wherein he had clarified the
    position and sent a copy of the DEC guideline to be followed in establishing
    Distance Education Wing anddevelopment anddesign ofthe courses. A copy
    ofthe letter dated 26.92001 is annexed herewith as ANNEXURE-E/1
    9.2 The deemed university-Opp. Party No.4 again made applications for
    approval of programmes through distance mode, on 1.8.2005 and 24.8.2005
    which were answered in negative by the Deputy Director and the Director on
    16.82005 and 13.12.2005 respectively. Copies of the letters dated 16.8.2005.
    and 13.12.2005 are filed herewith and collectively marked as ANNEXUHEmiSERIESi.
    9.3. In spite of fact that the application for approval of the deemed
    university-Opp. Party No.4 for distance education was rejected the deemed

    university run distance education for which number of complaints seeking
    clarification on recognraWapprovai status ofthe programmes were received
    by the DEC from the individuals and organizations. In an attempt to answer
    on the complaints the DEC issued anotice/circular on 5.1.2006 clarifying that
    four universities do not have approval ofthe DEC. Acopy ofthe notice dated
    5.1.2006is filed herewith as yJNNEXURE-GSI
    10. That since the Opp. Party No.4 didn’t adher to the various policy guide
    lines fiamed by the DEC and other Statutory Authorities on the subject and
    anticipating some coercive action by the authorities, number of writ
    applications were filed and are pending in this Hon’ble Court One of such
    writ applications pending is W.P.(C) no.15163/05 filed by Orissa College of
    Engmeering and Management
    •10.1 J#«tfever, subsequently taking everything into <xmsideration specially
    iemterest ofthe students, the DEC has granted one time post fecto approval
    to the Opp. Party No. 4on the recommendations of the joint committee of
    UGC-AICTE-DEC in Aug-2007 for the programmes (approved by statutory
    bodies of the University) offered through distance mode till 2005. The
    University-Opp. Party No.4 has also been accorded provisional recognition
    for one academic year i.e. from June 2007 to June 2008. Your humble
    deponent further submits that while according provisional recognition for the
    period from June 2007-2008, they are advised to submit fresh application in
    the prescribed format developed by DEC. The university had submitted the
    application ofrenewal ofrecognition, which is under process. Meanwhile, the
    university has been granted continuation of provisional recognition till such
    time an expert committee visits the University and submits its
    recommendations to the DEC. It is further relevant to submit here that the
    DEC has given institutional approval in place of programe approval for
    offering programes through distance mode to above University. Therefore,

    the DEC has not given any separate approval to any specific programmes
    offered by above University. Further, in case of technicai/professional
    programmes offered by the University i, concerned, wherever required,
    approval from the concerned apex bodies in the country is required to be
    obtained for which the responsibilityvests with the university concerned.
    in the mean while some persons filed acase bearing number W.P. (C)
    No. 15725/2008 with aprayer to direct the Opp. Parties not to take any action
    to cancel the process of selection. The Hon'ble Court passed the order on
    16/04/09, relevant portion ofwhich is quoted below

    meeting was held on the issue ofrecommendation of diplomas awarded by

    concluded that the DEC has given institution recognition to JRN Kojmlhan
    Vidyapith for offering me programmes (approved by statutory bodies of the

    can be seen from a bare perusal of the writ application and the
    averments made in the writ application may be read as a part
    and parcel of this miscellaneous application in order to avoid
    repetition and for brevity.
    3. That it is now understood that the opposite parties
    are taking hasty step to some how to fill up the vacant post of
    Graduate Engineer Trainee ignoring the candidature of the
    petitioner solely on the ground that the certificate granted by
    the Deemed University is not acceptable.
    4. That it is further learnt that the interview is scheduled
    to be held on 18.09.2011 and the petitioner has not been called
    to the above interview. If such interview is held and the
    petitioner is not called to the interview, he will suffer irreparable
    loss and injury.
    5. That it is respectfully submitted that the application
    of the petitioner was processed and online registration number
    was assigned to him, but due to such arbitrary action the
    opposite parties are depriving the petitioner of getting
    promotion to the post of Graduate Engineer Trainee.

    It is not a judgement of Orrissa High Court, only interim order reserving one post to be kept vacant for petitioner in case he win the case. Normally interim orders are given with hearing the other party and the issue will be dealt in the final hearing or during vacate stay petition. with regard to Supreme Court`s judgement I have not heard of such judgement in favor of deemed universities, allowing them to go for distance education. In 2009 in Annamalai University case(division bench of Punjabh & Haryana Court relied on this judgement on 6th Nov 2012) In the year 2011 & 2012 Supreme Court delivered land mark judgements dealing with conducting of professional courses with out approval of Apex regulatory bodies of the country.(mainly NCTE). It was not even conceded the plea that students are being put loss due the Judgement.

    dear friend! as in the case of Orissa High Court, Supreme Court have also given interim order not be harsh on the certificate holders of deemed universities, as per the judgement of division bench of Punjabh & Haryana High Court, and asked the parties to submit their arguments by 14-12-2012, for further decision on the issue. as already clarified interim orders cannot be construed as judgement. let us wait for the final judgement of the Apex court, and guilty need to be punished as per directions of J &K court for issuing fake unauthorized degrees & acting as qualified with such degrees.

      There has been numerous arguments in favour/against the distance degree/diploma courses in technical courses such as B.Tech/diploma in engg.
      There has been orders of various high courts/CAT on this subject, out of which some are in fovour and some are against these degree/diploma.

      However, to inform all concerned about the latest developments on this issue, please be informed that the judgment of hon’ble double bench of punjab & haryana (by which these degree/diploma have been declared as ” INVALID”) has been challenged in hon’ble Supreme court of India by way of SLP in a case titled as vijay kumar and others Vs kartar Singh and others.The next date of hearing is on 1.3.2013.

      Now this issue has reached to a place where it will be decided once for all by hon’ble supreme court of India. so, i would request to all concern, not to go by contradictory replies of DEC/UGC/AICTE/MHRD because they all are misleading citizens in their own way.

    NHPC Ltd , the first public sector undertaking under government of India has gone to the extent that they have even rejected the B.Tech Degrees civil done from IGNOU , a only central open University directly running under Ministry of HRD , Government of India . It may be noted that even person who completed these degrees in 1999 from IGNOU have not been spared on the plea that it needs to be expost facto approved from joint committee. where as Court itself has said thses type of committee cannot grant expost facto approvals. Can any body has any idea ,, whether this committee examined any central niversity and if they didnt then why ??

      but in 2nd point it says that who are already enrolled for them some guidelines should me laid down. what are those guidelines????

    One thing is 100 % percent confirmed..after meeeting several lawyers ,, Joint committee and tripartite committee has no power to grant expost facto approvals… In whatevr cases it gave expost facto approval.. court has termed this approval as illegal..

    with regard MBA/MCA the students may go through the web sites of AICTE & DEC to be doubly sure of it`s recognization. as discussed earlier as far as BE/BTech/MTech/diplomas and other degrees are concerned the cases are pending Hon`ble Supreme Court of India and posted for next hearing on 22nd March2013. I request all the intellectuals who are well aware of the foul play of DEC & it`s the then head and 4 deemed universities to mobilize for effective presentation of arguments & try for transfer of hundreds of cases which are pending at various High Courts & Tribunals. this will end the litigation at once.TQ.

I waited for our other friends to react on this, but nobody responded till now!we need not sympathize with the sufferers of deemed university students of distance education. most of them(over 95%) are in service employees who want to get elevation in their rank at the cost of genuine degree/diploma holders, they fabricated these degrees without writing exams/ with out applying leaves on date of examination. a CBI inquiry is needed to punish the culprits. one who is behind this conspiracy is behind bars in another case. let the law & systems in this country such as courts & apex bodies take action to prevent& protect national interests & common man.     friend, you have correctly said that more than 95% of distance B.Tech holder are in govt jobs for more than 15-20 years.Since they could not obtain part time/ AMIE qualification ,they opted for this channel during 2003-2009. In fact, they were not cheated by these universities rather it was their calculated risk to obtain a degree by spending some money to get promotion. I agree that a few innocent persons might have been misguided but majority of these students are quite smart and well paid of by their deptts. Spending few thousand rupees and hardly putting any effort for getting promotion is a smart option. Any sympathy with such promotion greedy persons is highly improper and will be at the cost of genuine degree holders. I just cannot sympathize with them. sorry boss.

    JRN Rajasthan vidyapeeth university is one of the 44 deemed university whose recognition was cancelled by UGC/MHRD in 2009-2010. all the 44 universities challenged this action in hon’ble supreme court which stayed the notification. the case is pending since then. you may track the progress from website of supreme court. the case no is writ petition civil 142/2006.

    any course offered by deemed university through distance mode either directly or through study centers is not valid, courses offered in main campus of the university in non technical courses which being taught prior to awarding deemed university status are valid, even though case is pending before Hon’ble Supreme Court & only fresh admissions in the main campus will be subject to out come of the case as far as I under stand.

    We have studied the case & our views are as follows –

    1. In distance education all the qualifications are valid once provided that this deemed universities / state universities / state open universities / central universities / ODL institutions have approval from Distance education council.

    2. Distance education council can give approval on prospective basis & cannot give post facto approval. i.e. students admitted by JRN university for any course in the academic year 2007-2008 are the valid students & there degrees are valid once . Other students will have to appear for a qualifying certificate examination. Pl see attached NEW POLICY ON DISTANCE LEARNING IN HIGHER EDUCATION SECTOR by prof. Yash Pal.

    3. There is huge class of people who cannot complete or completed their education due to various reasons. The Main reason is financial problems & cost of education. It is Government’s responsibility to provide them the opportunity to complete their education at reasonable cost. Distance education is only the way forward by which they can complete their education while working, can build their career & by this they can come in main stream of the society & contribute in nation’s growth. Pl see attached Prof. N R Madhava Menon comeetee report for your reference.

    So all distance education students you dont have to worry just focus on your study, do hard work & study sincerely. Law will give approriate punishment to all institutions which are violating the rules & regulations.

Firstly, I want to draw your attention to the MHRD,GOI notifications which is quoted below ” Minisitry of Human Resource Development, Govt of India Gazette notification No. 44 F.No. 18-15/93-TD. V/TS.IV dated 1st March 1995, states that ‘…..On the recommendations of the Board of Assessment for Educational Qualifications, the Government of India has decided that all the qualifications awarded through Distance Education by the Universities established by an Act of Parliament or State Legislature, Institutions Deemed to be Universities under section 3 of the UGC Act, 1956 and Institutions of National Importance declared under an Act of Parliament stand automatically recognized for the purpose of employment to posts and services under the Central Government, provided it has been approved by Distance Education Council, Indira Gandhi National Open University and wherever necessary by All India Council for Technical Education, New Delhi…..….’”. It is a final say on the recognization of qualifications acquired through distance mode and whenever technical degrees /diplomas are awarded through distance mode AICTE’s approval is mandatory.I want to see the response from MR.Ameet Kumar for clarification with regard to his conclusions drawn at para 1 of his notes above .
    1)Till today AICTE is saying that they have not given any approval /post facto approval to any technical degree/diplomas through distance mode .
    2)Another violation by the deemed universities is that they have opened study centers in different states (outside their jurisdiction )which is against state education act of the concerned states .
    3)while giving deemed university status there is a condition that these universities will follow the guide lines of UGC from time to time .But they have opened study centers without the prior permission of UGC .This is another violation by these deemed universities.
    4)Joint committee of UGC-AICTE-DEC was formulated as per MoU between the 3 apex bodies in order to have a single window processing of applications for approval of distance education courses . none of the powers of UGC,AICTE and DEC are delegated to this joint committee .hence its approvals are to be treated as naught.
    5)with regard to new policy of higher education I think that it need to be enacted in the parliament.
    6)we are not against to the policy of spreading the higher education avenues through distance mode ,but it should be in a proper supervision of statutory bodies and in consonance with the law of the land .
    7)In our experience in AP state ,we found thousands of engineers in public service brought distance degrees in engineering within a span of 1 or 2 years from the study centers of deemed universities located in state of AP.As UGC and AICTE is saying that these degrees are not valid ,we are not going to the details like date of admission,dates of examinations,leave particulars of examinations,examination centers,particulars of answer scripts(question papers are supplied to the candidates at their residences and certain ghost writers wrote these answers)etc.,
    8)all these in service employees who obtained diplomas/degrees with the above methodology are creating hurdles for genuine degree/diploma holders born in service .Till today agriculture superintending engineer who was proved to be holder of this fake/invalid degree was not reverted back , inspite of vigilance report ,Lokayuktha orders.
    9)With regard to honorable High Court of Chatisgarh ,it was ordered to review/reconsider the decision of earlier order of govt of Chatisgarh that the qualifications are not valid .It was not a judgement delivered going through the legality of the issue as was done in case of judgements delivered by Punjab and Haryana High Court ,Jammu and Kashmir High Court ,AP High Court and Central administrative tribunal ,New Delhi which were quoted in my comments made earlier .However let us wait for Apex Court’s order which was posted for final hearing on july 31st,2013 on the appeal against Punjab and Haryana High Court’s order .

    Dear Shri Ravindra Ji, I would like to know ur view on B.tech Civil Imparted by IGNOU University. None of the Points cited by Chandigarh High court hold s true for IGNOU University and state below :
    1. IGNOU IS THE CENTRAL UNIVERSITY INACTED THROUGH PARLIAMENT LAW.
    2.IGNOU has not only created to impart only distance education in INDIA but also its promotion and regulation throught the Statutory body Called DEC(Distance Eductaion Council).
    3. IGNOU IS NOT AN INSTITUTE neither it was during its creation (REFER Chandigarh High Court Rulling for all reference)
    4. IGNOU did not follow MOA as in case of all private institutes which has to impart only courses decided in MOA.
    5. IGNOU HAS PAN INDIA Jurisidction . Where as Private institutions and Private/deemed university has local/state juridiction as the case to case.
    6. Private and deemed university are institute first and then converted to deemed university. Thus as a initial basic entity they are institute and needs AICTE approval mandatory as a statutory requirement.
    7. There is difference between the Central University like IGNOU born through statute and deemed university born under statute.
    8.In AICTE act if u will study it deeply its clear that AICTE has no regulatory control on Central and State Universities like IGNOU. E.g There are many courses run in IIT’s and Delhi University which are not AICTE recognized. And mind they are not illegal.
    9. In several high court and supreme court rulings its had been well established that AICTE has only suggestive rule when Central Universities or State universities are concerned and its not mandatory.
    10 The degree imparted by IGNOU has well defined credit system and minimum contacts hours as stipulated in UGC guidelines with Practicals/Laboratories done at CSRMI , IRC and NIT Kurushetra which are mandatory.
    11. The duration of the course is 4 years unlike 3 yrs etc followed in RVD and IASE.
    12. There is no Lateral Entry system unlike done by RVD and IASE .
    13 And above all the 4 year B.Tech Degree programme ran BY IGNOU under the nose of HRD ministry , with budget allocation by MHRD since 1995 till date is DULY RECOGNISED BY union public service commission of India for IAS AND Engineering Service examination.

    I hope this will differentiate ur views about IGNOU from others.
    At the end i would like to say that :- If u see basket full of rotten apples ,, Its ur wisdom by which u need to seperate the rotten one’s with right one’s :-)

    If u think AMIE is better i can bet u r wrong.. AMIE is an private society with no bar on number of attempts ,, no practicals/laboratory arrangement , no surveying exposure. Morover people start young and keeps trying till they are cleared,, where as in IGNOU maximum duration to clear is 10 yrs. One more data for your information… In our company there are 500 candidates from RVD AND IASE , whereas from IGNOU only 8 nos candidates have cleared B.Tech from IGNOU TILL DATE ..
    So data speaks more than words doo..

    The approval method has been changed in 2009. What about the students who are enrolled before that time. Its misleading RTI.

    As per notifications, in 2009-10 and own ward B. tech/MCA/MBA course without approval will be invalid. This is true for those who started in 2009 or later.

    For those who appeared before that is not mentioned in RTI.

    The question is not clear and answers are also not clear.

    Dear friends!
    As far as recognization is concerned GOI notification 44 dated 1-3-1995 is final.Unless a fresh notification amending the above is issued.even though AICTE have a role of advisory as per the act,it has regulatory role in case of institutes offering technical education and advisory role to UGC,in case of universities.
    But notification of MHRD referred above made it mandatory (approval of AICTE wherever necessary along with DEC).
    Everybody who is coming for the support of deemed universities and its students are time and again referring joint committee approval.None of the powers of either UGC,AICTE & DEC are delegated to this joint committee.Its approval is just like signing of an order by incompetent authority.
    This can be seen in the judgement’s quoted by me in my earlier postings.
    With regard to comparison between other deemed universities with IGNOU and AMIE,i don’t want to enter the mess as it is for the institutions to support their stand and credibility.Even in such case also whether it is a national university or local university it need to follow the statutes.It is just like a govt vehicle driver need to have driving license even though the vehicle belongs to govt and driver is a govt employee.
    In our organisation also there are 300 to 400 IASE/JRNU/VINAYAKA MISSION graduates where as only 2 AMIE qualified and 4 IGNOU qualified degree holders.As per Dhairya’s argument shall we rate AMIE fellows as the best? We are born graduates passed out in the year 1984 and joined in govt service in 1985 are being obstructed by the money power & litigation mentality of deemed university degree holders who obtained these degrees in the year 2006.In fact they have taken permission to study degree in engineering in the year june 2005 and passed all 48 subjects by june 2006 which is humanly impossible.
    As ordered by his lordship MIR AHMED NUR in his judgement quoted by me earlier,a detailed enquiry need to be done by CBI,how and why these study centers are allowed to be opened and what the regulatory bodies are doing all the while.Only in one case CBI has taken some action as reported in news papers with regard to irregularities took place in giving permissions to distance mode education indiscriminately.
    However let us wait for the apex court’s order in this regard and anybody who wishes to submit their grievance through an advocate before the concerned bench.

      Sir,, Dont take my views in wrong spirit. I am not here to support any one . Which is best cannot be decided on numbers but which is worst can be.. Like u quoted of candidates enrolling in 2005 and completing the objective type question papers in 2006-07 though IASE AND RVD.
      My argument is in support of IGNOU only. If some private Institutes/Deemed Universities commits wrong practises in connivance with AICTE DEC AND UGC either by giving money etc to their official which actually happened for years in past , then court should look beyond ,, by not only passing judgements on what is valid/non valid , but fixing responsibilities and punishing for setting eg to act as deterrent in future.

    1. MHRD vide its Notification No. F.23-I/2003-TS III dated 17/02/2004 & No. F2-1/2006 U.3(A) dated 7/4/2006 had cleared about recognition of qualification & role of AICTE respectively. This notifications supersedes earlier notification No. 44 F.No. 18-15/93-TD. V/TS.IV dated 1st March 1995.
    2. From time to time AICTE had cleared that they are not the authority so there is no question about AICTE approval.
    3. As per the Hon. Supreme court judgment in Appeal (civil) 2056 of 1999 Universities did not required approval from AICTE for technical education.
    4. As per Prof. Yash Pal committee report let this qualifying certificate examination should take place as early as possible to ensure the credibility of the students as well as the concern universities.
    5. Latest updates – DEC has been repealed & deleted (With the approval of GOI) & all the regulatory responsibilities for Open & Distance learning are upon UGC. UGC is working on rules & standards for distance learning. Please refer UGC notification F-3-2/2012 dated 28 may 2013 on UGC website.
    6. Latest updates – As per the Hon.       Now the Questions arises: Why B.Tech in Distance learning should be INVALID, rather than appying some guidelines.

      Ans) Start thinking in a positive way to benefit the society..
      a) Govt should work on some guidlines..for e.g.3year Diploma holders with few Years of Work Experience should be allowed to complete B.Tech in Distance/part-time/correspondence( This is what AMIE/IETE/IEE/IME guidelines also speak of).

      b) Relevant Govt authority should keep a watch on the intake and passout candidate list Stream wise, for each University.Issue a Roll Number that can be checked at the Government authorised Website. This will keep a track of Un-authorised Universities taking admissions, and also ensure Students confidence of studying in an authorised University.

      It is very pity to understand after completing the course that the University is Fake/Not-Authorised to carry the subjected course.

      c) Admission for 10th/10+2 school level qualified, should not be entertained for Distance learning B.Tech.

      d) B.Tech distance learning should be of a minimum 3 years/6semester time Period.

      If the Govt is correcting themselves of their mistakes..by defining fresh guidelines..Then the Students should not be made scapegoats.

      It has pan India Jurisdiction.. Born through Parliament act.
      It can Impart distance eductaion through its respective statute.
      Infact IGNOU was only created for distance education.
      Btech course was created by the faculties of IIT .
      Practicals and lab are carried out in Face to face mode at CSIMRS AND Kurushetra University

      Every thing is clear..
      There is no court case related to Btech from IGNOU in any court..

    I would like to hear something on AMIE and IETE B.Tech courses…..Why is the Min of HRD/UGC/AICTE/DEC not talking on the courses run by them…and keeping them separate. Are they not Distance learning programmes. Why is the name and law changed in their case.

    What is AMIE and IETE doing, is it different to what RVD university or such Open Universities are following. The first and foremost thing to be done is to Provide equal guidelines for Distance Education in India. It is the Governing Bodies(UGC/AICTE/DEC/Min of HRD) who has to keep vigil on the proper functioning of the Universities coming under thir jurisdiction.
    As AMIE and IETE are promoted by Govt Bodies, Private Institutions should also be guided by the government, to perform in accordance to these guidelines. If things are not adhered, the governing bodies should clearly mention the Current staus of these Institutes/Univeristies with correct dates of action for the start and end dates in the respective websites, so that information is open.This is because Students would only enquire the status of the University before getting admission,the chances of revisit to this topic is very thin.

    So the drive should be for a better share of information through a Single channel.The present status only shows non functioning of responsible Govt Bodies.

    The Govt should pull the Legs of the Bureaucratic Bodies who are sitting and enjoying hefty benefits calliing meetings without proper resolution. I am saying this because even after 60 years of Indian Independence..We haven’t identified a proper/strict channel on the Indian Education System.

    We should kill the source of the disease to kill the disease, and not the diseased.

If you are a real RTI activist then start a agitation like Anna hajare to derecognise these institutions.actually your aim is to only punish those cheated students who have taken degree from said universities.

    Best example is”JHOLACHHAPH DOCTOR”

    means you are not taking action against unqualified doctors but you are taking action against cheated patients.

    Do some thing for derecognising the such universities running the illegal course and to save the future of students.

    dear friends! who got cheated by deemed universities are sufferers of those universities not DEC. RTI activists rightly unearthed the scam of deemed universities and it is known fact that no permissions are granted to deemed universities to conduct courses through study centers in distance mode. they managed with DEC and got so called post facto approval, for which neither DEC nor Joint Committee is competent.
    having known at the time joining the these courses not recognized or misguided by the deemed universities they should file suits against to those who cheated them.
    If we start blaming the people who fight against such white colored scams in future nobody will come to fight against such corrupt practices. tq.

    Friends! As per the above opinion the post facto given by DEC is also deemed to have been cancelled , hence it can be construed that no permission was granted from statutory bodies of the country.
    But as far as I know all actions and liabilities of an organization will transfer to taken over body.
    Let’s wait for the verdict of apex court, don’t draw hasty conclusions. Tq.

    Friend! please get it clarified from UGC, whether the university has complied with the conditions there in. If interested you may go throgh judgement of Punjab and Haryana High COurt’s division bench judgement in CWP no:1640/2008 dated 6/11/2012 & in paras 172,173 & 174, in which legal position was discussed in detail about post facto approval.(this judgement is available in this blog above, SLP pending in Supreme Court is up on above Verdict.

    before june 2009,The universities, duly approved on the basis of joint comm(UGC,AICTE,DEC)approval can start any of course approved the university statuary body in distance mode.Before 2009 DEC had not said to run or not to run particular courses in distance mode.After review of distance education policy in april/may 2009 DEC start to give cousre wise approval and ask to take permission of AICTE to run technical courses. In July 2009 MHRD clearly stopped technical course(BE,B.Tech) in distance mode. Dear ravindra kr jee,pl post any circular before 2009 of government or DEC etc by which it is being proved that B.Tech degreee course can not be start in distance mode.please post here.

Tech in various Deceplene on 2007 and Stop on August 2009, Whether this degree are valid or not . All those Degree are not approved by AICTE for course wise or University wise. only JRN Rajasthan Vidyapeeth University are approved Course wise i.e all course(THAT APPROVED BY Statutory Body of University)till 2005 by Joint Comittee of UGC-AICTE-DEC and 2007-08 for University wise refer Third Meeting of Joint Comittee. and ONLY DEC till July 2008-09 and upto July 2009 and by MHRD till Enrollment upto August 2009.     Dear ravindra k jee,please try to understand,My aim is to explain you,so that you may stopped the blaming of students communitiy of said universities.
    Notifications,circulars etc isued to students not to take admission in those university which are saying fully approved.Question is that Why DEC had not said about the name of course,name of universities involved as in said scam.
    Reality is that,no clearcut procedure was being adopted by DEC to grant permission,there was no ban on to run any specific course.
    please see the permission to St Peter University Chennai, in April 2009 permission is granted to run B.Tech courses in distance mode and withdrawn in september 2009.Thapar university was granted permission to run B.Tech course in june 2009 as per coursewise approval,and withdrawn its permission in august 2009 after MHRD circular.Andhra university had run the B.Tech course in distance mode up to sep 2009. being a government university DEc has given post facto.All approval to run the B.Tech courese in distance are based on the approval of tripilicate comm of UGC,AICTE,DEC.
    So it is clear that in 2009 B.Tech approval given by DEC.Before that no course wise apprval was being given.
    DEC changed its policy to run B.Tech course in disatnce mode when Hon. HRD Minister had issued letter to stop B.Tech course in distance mode.
    Now if you say that
    1- DEC has not accorded permission to run B.Tech course in distance mode is totaly false statement.if you have any proof please post.If you want to know the proof, I shall provide.

    Finally we can say that
    1- University should be duly recognised by DEC to run courses in distance mode.

    2- B.Tech courses in distance mode may be unvalid if admission is taken after July 2009.
    3- B.tech course may be unvalid If university was instructed by the DEC not to run technical courses in distance mode before july 2009.
    4- If particular university is accorded coursewise approval then only approved course can be run.
    5- There should be no comfusion that all Technical courses are stopped after july 2009.If any university is still taking admission ,It may be unvalid.

    All above clarifications are based on my study in distance education.

    If any case is pending in the court in this matter than we have to wait for the decision.till date we have to stopped blaming each other.

All that I can say that at the time of your joining in there are no approvals for your courses. Later post facto approval was given(of course it also with out jurisdiction and statutory powers) which declared as not valid in Annamalai University case by Supreme Court. all my comments posted earlier are relevant and my final conclusion is that all that we can do is waiting for Apex Court`s final verdict. tq.

    Recently,hon’ble double bench of high court of punjab & haryana has declared B.tech through distance mode as “INVALID” in a case titled as kartar singh Vs state of Punjab.Now the SLP has been filed in hon;ble Supreme court of India in case titled as “vijay kumar and others Vs kartar singh and others Special Leave Petition (Civil) 35793 -35796 OF 2012. the next date of hearing is on 23/10/2013
    please monitor the progress of this case to find out answers to your queries.

    This should have been a good way…rather than telling that attained certificates are Invalid..etc…

    Consider the remote locations where higher education is not reached or a middle man not able to afford fees..or an experienced person who wants to enhance his career.

    Distance/part time educations come in handy. The origin of AMIE/IETE were for such factors.But it becomes a sin when Other Universities try to follow their guidelines.

    If AICTE comes with some guidelines..it would be a good sign on Technical Distance Education for Experienced personnel with fundamental theoretical Knowledge.

    I have done Diploma from JRN Rajasthan vidyapeeth university in 2008-010, just i want to know it is valid or not, because I applied electrical supervisor license in Karnataka and they ask me bring the Technical Equivalence Certificate for the same, Then i ask to Karnataka technical board and they reply me like we are not give Technical Equivalence and eligible certificate for any distance education candidates,

    Then I ask them what the next solution?
    And they ask me get the below details,
    1.AICTE approval letter from university,
    2.Rajasthan Technical board approval letter
    3.Details of syllabus with seal and signature,
    Then they will try to give the Technical equivalence certificate.

    Can help me someone how to get all this and share any me any contact details of RVD University and how to get all this plssssssssssssssssssssss.

    JUDGEMENT AND ORDER
    [ O R A L ]

    Heard learned counsel for the parties.
    2. The petitioner-respondents were holding diploma in engineering and
    working in the Public Works Department, Government of Assam, as Junior
    Engineers. The qualification prescribed for the promotional post of Assistant
    Engineer is degree in engineering. The respondents-petitioners have taken B.
    Tech degree in Civil Engineering from the Institute of Advanced Studies and
    Education, Gandhi Vidya Mandir, Sadar Sahar, Rajasthan, a deemed university
    for the purpose of UGC Act, 1946. The said institute provides facility of distant
    educational learning and awards degree in engineering.
    3. The petitioner-respondents have obtained the degree in engineering by
    pursuing the course of distant education learning and they have been awarded
    degree certificate by the institute. The said degree is said to be recognised by the
    Director of Technical Education, Govt. of Assam, as well as Ministry of Human
    Resource Development, Govt. of India.
    4. The Service Rules envisage that whenever a diploma holder acquires a degree,
    he will be promoted to the vacant post of Assistant Engineer and such
    recruitment would be deemed to be a direct recruitment.
    5. The facts of the cases reveal that in the other departments of Government of
    Assam like Water Resources, Public Health Engineering, Water Transport,
    persons, who are similarly placed, who had obtained degree from the institute of
    distant learning, were promoted to the vacant posts of Assistant Engineers.
    technical
    institutions are required to obtain specific prior approval from the
    Joint Committee of UGC-AICTE-DEC for conducting
    programmes/courses in technical education through distance mode.
    In the public notice vide advertisement No. UB/03(03)/2010 speaks
    that qualification acquired by the individuals through distance
    education mode are recognised for the purpose of employment to
    posts and services under the Central Govt. subject to the condition
    that the same have been approved by the DEC-IGNOU, New Delhi,
    and wherever necessary by AICTE, New Delhi. By the said notices
    students were directed to check the approval of Joint Committee of
    DEC/UGC/AICTE.
    From the above, what is seen is that the approval of the
    AICTE in respect of the course in question may not be in direct
    form, but is on the basis of the approval of the Distant Education
    Council and also in the form of Joint Committee meeting of
    DEC/UGC/AICTE.
    In the instant case as noted above, both the petitioners
    completed their final examinations conducted in 2007 and 2008. As 4 
     
    per the aforesaid Joint Committee minutes, the Institute in question
    has already been approved ex post facto . For a ready reference, the
    resolution No. 3 of the meeting is quoted below:
    “3. Instructions applied for ex-post-facto approval
    “3. Instructions applied for ex-post-facto approval
    The Joint Committee accepted the recommendations for the
    Committee appointed by Dec for examining the institutions that
    have applied for ex-post-facto approval to DEC. It accepted the
    recommendations of granting ex-post-facto approval to all the four
    institutions namely JRN Rajasthan Vidyapeeth, Allahabad
    Agriculture Institute Deemed University. Vinayaka Missions
    University, Punjab Technical University and IASE Deemed
    University up to the current academic year i.e. 2007-08 ad the
    suggestions made by the visiting Expert Committee should be made
    known to them which should be strictly adhered to. However, they
    need to apply for formal recognition to DEC for the next academic
    year.”
    Above apart, another department of Govt. of Assam, Water
    Resources Department has already recognised the degree obtained
    from the Institute in question as will be evident from the letter dated
    07.10.2009 (Annexure-14) addressed to the APSC by the Govt. of
    Assam in the said department. After such communication the
    candidates with the degree from the said Institute have already been
    promoted in the said department. Thus under the same Govt. there
    cannot be two different standards.
    For all the aforesaid reasons, I am inclined to accept the
    prayer made by the petitioner for a direction to the State respondents
    to consider the case of the petitioners for promotion to the post of
    Assistant Engineer recognising B.Tech. (Civil Engineering)
    obtained by them from the Institute in question.
    The writ petitions are allowed. However, there shall be no order
    as to costs.”
    8. From the above, there is no manner of doubt that the course was undertaken
    by the petitioner-respondents. 5 
     
    9. The stand of the appellant-Department is dubious and untenable. When the

    With respect to above blog we would like to share our views with you:

    1. In today’s world if you want to live a good respectable life then there is no option for skill orientated technical education.

    2. Majority of the students enrolled in distance education system are working somewhere. They are doing their education while working and at the same time they are having responsibilities of their families, dependents.

    3. There should be various reasons for their incomplete education e.g. financial problems, unaffordable cost of education, remote locations, lack of infrastructure facilities like transportation, lack of appropriate guidance and advice on right time etc. etc.

    4. These working students have good hands on practical experience, knowledge and skills but they don’t have a certification and authentication.

    5. Due to lack of certification they are not receiving good salaries, not receiving growth opportunities, not receiving respectable working atmosphere, at work place they are doing the hard work but some other takes away their credit. One can observe, experience and see such kind of treatment is given in most of the organizations to the less/non qualified persons. In short, they have the potential but got exploited merely because of they are less/non qualified persons. And to come out of these they realize that essential qualification fulfillment is must. At present distance education is the only option for them to enhance their qualification while working. (Few programs are there in part time and mixed mode but they are very negligible in terms of numbers.)

    6. When we go through the statistics we have realize that students registered for distance education programs are in millions. Therefore there is a need to provide training, support, strength and appropriate direction to all these students. Government, concern authorities and Hon. Court should take certain concrete steps, programs for these students as these students have strong desire to grow up, to develop the careers, to come out of poverty and deprived status.

      i totally agree with the points discussed in your post. we all the sufferers are looking towards courts for validity or approval?If we have spent our hard earned money & time for gaining somthing.definately most of us will be ready to face any practical/written test for getting the validity/approval of our qualifications.After how much time Govt will take regularising menner when all of us will be overage for Govt jobs? as per MHRD letter No.DO-6-7/2009-DL dt.29/07/2009,Govt or concerned statuary body will prepare the way for validating the qualification aquired thru distance mode prior to stoopage by Govt. A long span of Five year passed and their is no clarity till now . Why the millions of students previously cheated by concerned University/ DEC/UGC/MHRD/AICTE or anyu Govt. body are suffering day to day with a mark of unauthorised / fake degree .why govt initiated to stop the same in 2009 & not in 2001.why Govt have not planned for millions of students aspiring for upgradation of education/skill/qualification.students cheated by all statuary body are continouisly being cheated by Govt.why the policy of engineering in distance mode prepared & posted by AICTE for New students Because it will prepare the business of millions of money for Approving authority/AICTE/MHRD/University/ colleges .while as it is supposed to develop the system for validation of millions of already enrolled students/passed out prior to any thing .can a RTI be developed for the same with reference to letter no. already quoted above?I think a RTI must be filed by Group4 change team to MHRD with reference to above letter & asking about the :-

            my issue raised is not the duration of approval between april 2009 to sept.2009,but the entire duration of 2001 to 2009 ,for which MHRD agreed that students admitted upto 2009 will have to clear some theory as well as practicals for validationg their degree aquired thru distance education .
            I am not thinking that the degree is valid or fake but as per MHRD these courses were operational in knowledge with all statuary bodies.as per MHRD some policy will be prepared for validation of these courses in the same duration.
            my issue is that weather govt. have prepared any policy in this regards ?

            if not than ,is Govt . looking for all students being overaged / for Govt. jobs?

            My question is that what is the course of action on MHRD letter as quote in previous discussion (july 2009)

E-learning applications and processes include Web-based learning, computer-based learning, virtual classroom opportunities and digital collaboration. Abbreviations like CBT (Computer-Based Training), IBT (Internet-Based Training) or WBT (Web-Based Training) have been used as synonyms to e-learning. Today one can still find these terms being used, along with variations of e-learning such as e-learning, Elearning, and eLearning.     Finally Ministry of Human Resource Development (MHRD) has woken up to the fact that “The council was dissolved based on the arguments that the DEC which was created by the IGNOU cannot be the regulator for other universities in respect of distance education programmes”. MHRD dissolved Distance Education Council (DEC) with immediate effect and University Grants Commission has been given the responsibility of Open and Distance Learning (ODL).The DEC under Indira Gandhi National Open University (IGNOU), was the apex regulatory body for distance education offered by universities across the country. UGC Secretary in his letter addressed to the Vice Chancellors of all the universities has said, “Distance Education Council (DEC), has been repealed and deleted with immediate effect. Accordingly, DEC of IGNOU stands dissolved.” Ministry of Human Resource Development, government of India has entrusted all the regulatory responsibilities of ODL education system in the country upon UGC. UGC, in the meantime is working on development of appropriate regulations for maintaining standards in ODL programmes,” the letter says. UGC has also asked the universities not to affiliate any new centre of ODL till it comes up with new regulations. The council was dissolved based on the arguments that the DEC which was created by the IGNOU cannot be the regulator for other universities in respect of distance education programmes. The HRD Ministry had belatedly woken up to the fact that there is an apparent conflict of interest between IGNOU and other universities when it comes to offering courses through the ODL mode. Many universities are offering distance education courses without even caring to seek the recognition of DEC. To end the confusion prevailing in the field of distance education system, the Madhava Menon Committee had first recommended removing the DEC from the purview or the IGNOU, which was strongly opposed by the IGNOU Teachers Association. Supporting the move, former Vice Chancellor of University of Madras SP Thyagarajan said, “The council is the regulatory body for the distance education programmes in the country. If one of the universities is going to be operating the council itself, there may not be uniform maintenance of standards.” Hence, he felt that “ideally, an independent council should review every programme offered in all institutions.”

Distance Education Council which is part of IGNOU has destroyed the Online & Distance Education by its ridiculous decisions.     1. Please check the updated list of Recognised universities for distance education studies available on UGC website. Click on tab DEB and then List of Recognised University / Institutes with Courses.
    2. Janardan Rai Nagar Rajasthan Vidyapeeth is listed at Sr. No. 139.

    3. As per the list and documents, Post facto Recognition is granted to University till 2005 and Provisional Recognition is granted for the academic year 2007-2008.

    4. Continuation of Recognition is granted to university for academic year 2008-2009, 2009-2010, 2010-2011 and 2011-2012. This Continuation of Recognition is subject to the decision of the Hon’ble Supreme Court of India.

    5. Therefore students admitted till 2005 and in the academic year 2007-2008 are the valid students and their degrees are valid.
    6. This all above is about a specific university. But Prof. N R Madhava Menon committee and prof. Yash Pal committee has studied the entire case throughout and forwarded their recommendations which will make significant impact in education sector as well as career enrichment and growth in individual’s life. Therefore UGC or Government may design programs and examinations for existing and current students. Everyone should accept and welcome such programs and examinations as these are the competent authorities’ and eminent academicians. This will not only help the students but also remove if’s and but’s, doubts for distance education qualifications from everyone’s mind.

      first of all this is due to lack of co ordination between Govt /regulatory bodies .
      if this was not as per standards of technical education than it may be stopped in earlier dates.
      i hope every sufferer student will be ready to compete any exam for getting the validity .but I am afraid how much time required to prepare the scheme/programme for this. Five year span has been passed after the decision of MHRD.
      should Govt./regulatory body requires more than five years for the same ? Even after five years the Govrenment of country has been changed.
      If system is too slow than what we can expect ,that Govt. will prepare the policy till we almost maximum of us will be Overaged for Govt. job&carier upgradation.
      Pl check AICTE wavesite, AICTE prepared a policy for making approval to engineering colleges/courses in blended learning/Distance learning mode for future students (in folloup of MHRD letter Dated 20 july 2009)while as we the already enrolled /passedout students are still waiting.It does not seems that Govt regulatory bodies are making decision with commercial aspect only(making money for colleges,university,regulatory bodies for running/approving the courses)& not on human ground that decision for already sufferers should be on before the policy made & displayed for implementation.

      I Think we should make a close follow up with Regulatory bodies for speedy action in this matter.Even A RTI may be filed to MHRD for the same as already posted .

    It is very surprising to read the comments/debate of student on the issue of validity of distance B.Tech degree/diploma from RVD/IASE when Hon’le double bench of High court of Punjab has held it “INVALID” .Furthermore, the case is presently subjudice in the Hon’ble Supreme court of India.
    It is absolutely unwarranted to debate the issue when the matter is pending in Highest Court in the country.

    Our nation is a democratic country and everyone have the right to express own views in a decent manner. Sometimes we miss the facts and information therefore effective two way communication is very essential as it plays a vital role in resolving the issues.

    When we go through the documents we realized that in certain cases approvals are granted for distance education therefore there degrees are VALID once and that’s why we are supporting student community because students didn’t made any mistake and students should not be victimize for different reasons.

In Aswini Das Adhkari Versus State of Orissa and Others W.P.(C) No. 24611 of 2011, as per the directions of Honourable High Court of Orissa ,Cuttak ,dated-16.04.2009 a High Level Committee was constituted, by the members and directors of UGC,AICTE and DEC, in order to find out if the certificates issued by UGC/AICTE and DEC are correct/genuine and acceptable. That it was confirmed during the meeting – that the Joint Committee of AICTE-UGC-DEC on 07.08.2007 accorded provisional recognition for a period of one year 2007-2008, to JRN-RVD, for offering programmes that are approved by the statutory bodies of the University, and this provisional recognition was extended till the committee visits the institution for recommending regular recognition to the institution and its program. It was also informed in the meeting that DEC accorded post facto recognition to JRN RVD 2001 to 2005, for the University programmes, where it was also informed that courses in Mechanical,Electrical and Electronics were part of the programmes which were offered by JRN Rajasthan Vidyapeeth through distance Mode. Also the University was given provisional recognition and was asked to continue till committee visits for regular recognition to the institution and its program.Dr. Suresh Kumar Tripathy , Regional Director , Indira Gandhi National Open University confirmed that University may award degrees to the candidates , who have successfully completed their courses including those conducted through distance education mode at their own centres in different parts of the country with the approval of UGC. Also, it was confirmed that once institute/University has been recognized by DEC it is obvious that degrees and diploma awarded by the concerned institute/university are recognized for employment and further education in central government. It was also confirmed that DEC has never rejected the certificate in question issued by JRN RVD.

      Its good news for all…..you can see the news in media too. Just google “Ban on distance BTech lifted”. See The Telegraph newspaper report about the lifting of 6 year old ban on distance B.Tech & M.Tech in the attachment. Regulators and govt. should improve and maintain the quality of distance courses rather than putting a ban on all distance courses. ICT Technology has advanced to such an extent that even some engineering labs can be conducted in distance mode via online. Let Indian Universities not lag behind in adoption of these technologies so that the large number of students who dont have access to regular courses can be benefitted via distance mode. AICTE seems to have noticed this and now and they have put a regulation for blended mode degrees. Why make such a fuzz on “degrees” & their modes these days…ultimately what counts in getting a job is ones knowledge and attitude rather than lables of degrees.

    I am stuck in a situation. I have started working for an MNC in May wherein they did my background verification and told me that degree issued by JRN isn’t valid. I have shared MHRD letter with them as my course duration was June 2008 to June 2011. Now they are asking for an authentic source of letter, either it should be on MHRD website or any other well-known site. I tried to find the letter on MHRD site but its not there.

    The Court ordered CBI to inquire in to the matter. The only relief given to students who were admitted between 2001 to 2005, is to appear for an examination to be conducted by AICTE & get themselves to pass such examination to get their degrees validated. This decision need to be reviewed, as all those who have obtained such degrees are working in Government sector and know pretty well that these degrees are not recognized. To get in service promotions they resorted for such illegal activity. These universities and all these people are capable of managing any system/examination. Hence I feel that this is need to be reviewed.

    I want to know is there any case in which employer has taken any action on his employee after 3rd November, 2017 supreme Court judgement of suspending Btech degree of 2001-2005,Also is there any state/Central government letter telling not to take action on employee who has done Btech in between 2001-2005 and wait till Aicte test result.
    Also someone tell me the syllabus of this aicte test,Also please reply to this post as soon as possible as employer is planning to take step against me.

    Just to conclude a clarify it is very obvious that students who have enrolled for Distance Btech in Janardahn Rai Nagar Vidyapeeth University, under the Btech couses approved by the satutory body of the University, where DEC and UGC ahve also given recognition are recognized for the periods of 2001 to 2005 and 2007 to 2008 and 2008 to 2nd July 2009 .

    However, students from 2014 it is very much obvious that all Universities have to take approval from AICTE for conducting technical courses.So, please check out recognition status of universities before enrolling

    Keep trust on JRN Rajasthan University its very much legal and have stood up for its students and have always provided documents more than any other University has done for its students.

    Any new devlopment in case. Will govt. take back promoted person in govt. jobs , will govt. dismiss persons who have got services with these degrees ? will promoted amount be taken from them till date & they will be de-promoted to original post? what about who have retired ? Ultimately students are suffering only.
