1. Subject Matter: Private/corporate ownership, lease-rights or other title over
a. any part of the following lakes, lake basins and catchment areas: Walwhan, Shirwata, Shiraota, Kundli, Mulshi, Bhushi, Tungan, Uksan and Thokerwadi which r in maharashtra (Pune Lonavala region )
b.  any part of any of the following rivers and river-basins and catchment areas: Indrayani, Andra and their tributaries which r in maharashtra (Pune Lonavala region )
c. land in the transmission corridor from hydro-electric generation facilities on the above-mentioned water-bodies which r in maharashtra (Pune Lonavala region and runs up to Mumbai )
2. Description of information required: Please furnish the following particulars and copies of relevant records:
a. Area & map of each of these lakes, including catchment area: Walwhan, Shirwata, Shiraota, Kundli, Mulshi, Bhushi, Tungan, Uksan and Thokerwadi
b. Area & map of each of these rivers, including catchment area and river-basins Indrayani, Andra and their tributries
c. If any title or rights over any of the above mentioned rivers, lakes and their catchment areas (partially or fully) belongs toa private or corporate entity, please name the entities and mark their approximate ownership in above-mentioned maps of area, and give the figures.
d. If any revenue is collected by title-holders from the villager and farmers for the use of water from the basins of dams, lakes or rivers controlled by them, please give details of the same.
e. Name the villages on the banks and catchment areas of the above-mentioned lakes and rivers, and mark their areas on separate maps
f. Copies of documents that confer ownership rights, lease rights, or any other form of rights and entitlements on private/corporate entities
g. Copies of legislations, guildelines, GRs etc. governing the rights and entitlements enjoyed by these private/corporate entities
h. Details and annual figures of all revenues collected by Government from private/corporate entities as consideration for each of above-mentioned entitlements.
i. Also, similar mapping, title and revenue details for Transmission corridor passing through forests, villages, rural roads.
j. Copies of documents conferring permissions & rights to erect transmission towers in jungle and villages, etc.

    The RTI query should be addressed to PIO, Collector of Pune and PIO of the irrigation dept Pune termed as MKVDC and PIO of the relevant revenue department if the rivers fall out of pune district. Requesting you to find out the correct PIO/PIOs and get back tks

      Hi Vinita,

      As per reason provided by Jitu, RTI Application can be sent to any SPIO if relevant is not known and SPIO will transfer it to the concerned one.

      Also, a part/questions asked in an RTI application can be forwarded to many different concerned deptt by SPIO. So it can be filed with PIO, CM Office. Please revert back if you see any issue in such procedure, else we can move it to Drafted RTI section.

      Team: please delete item 3 from this application before filing “3. Information required will be collected in person.”.

    Since exact postal address of certain departments is not known, If RTI application is addressed to CM office, under law it is mandatory for CM office to direct such application to the respective department. Layman need not worry about the exact postal address. Also not here the transmission corridoor that we have refer to runs from Pune Lonawala till Mumbai, so falls under juridiction of many Collectors, irrigation department and Revenue department. so such RTI application be best addressed to CM office to get all necessary information for applicant.

    yes i agree that it can be sent to the CM’s office but this should be done as the last resort if you do not want delay in information. Hence, it is better to spend time on finding out the PIO and the department nearest to the query. In this case i think you should also address it to Pune Collector and Thane Collector besides the CM office.

    Dear Kamal, i think there is some mistake. This replies that u have got is says that the matter is refered to Public works department for them to search all reacods and to sent u necessary reply under RTI. This is no way connected to above refered Tata lake issue. So may be u have received this reply to some other RTI related to road issue. please check and let me know.

    Public works department (PWD) department may be related in this case just up to transmission corridor related issue, otherwise, the issue raised in this RTI r related to different Collectors under whose jurisdiction this huge area of river, lake, Dam and transmission corridor falls. also RTi issue relates department of Revenue and forest department as much of there is forest land. But in no case just PWD department. So even if PWD department gives some replies, it will only be partial.

    The study, which will be a survey in nature, is being carried out at the Thokarwadi, Shirwata, Mulshi, Valwan, Lonavla and Kundli lakes which are natural water bodies. (All these lakes r refered in our RTI .)

    The Sumant Sarovar was the first. A 200-metre dam was built across three seasonal streams. ( Since this lake is a out come of Dam built on a natural seasonal stream as claimed in this article, this is a national wealth so is access to these lakes and streams alloowed to any citizen of this great nation freely or is it that only people that Tata allow and wish, can enjoy them. This is a new finding apart from what we have been investigation in our RTI, about 6 lakes under control of Tata’s that r used for hydroelectric production. This is another area of investigation.), using debris from the factory buildings that were then coming up. It is situated in the 400-acre residential area that is separated from the main factory area by a highway. A second lake, the Sharma Lake, was created to take the overflow. The lakes are fed by rainwater ( again a natural resource )and also by recycled water from the plant.

    I hope my analysis and interpretation would help in understanding the issue better with reference to this RTI.

    This is to draw ur attention, how Maharashtra govt. has used deliberate or ignorantly, tactics to divert the RTI application to a non relevant department may be to avoid giving full and complete reply. I request media to highlight the issue in national interest.

    Today’s SC judgement ‘it says the natural resources such as spectrums( airwaves) has to be kept in public trust and has to be used only for the public benefit.

    If it is given out to private person it should be done only through transparent public auction. If any company has made illicit money through non-auction of the natural resources or if the company has got it at throwaway prices by non-transparent ways, then that allotment, grant or largesse has to be cancelled or withdrawn.

    That resource should be put to public auction so that the value of that resource could be realised for public benefit.

    THE ABOVE ORDER SHOULD ALSO APPLY TO TATA’S WHO R EARNING BY POWER GENERATIONS BY BUILDING DAM ON 6 NATURAL RIVERS IN PUNE REGION.

    When contacted a Pune base reputed newspaper(since the issue is related to Pune region), i was informed that all media r afraid to touch anything against Tata’s in fear of legal notices. Lets see who shows guts.
