Information is required related to Number of Legally (T.M.C. Approved) Constructed building/houses and illegal constructed buildings/houses in the city of Mumbra and Kausa under the jurisdiction of Thane Municipal Corporation.

Subsequently, information is required, related to the action taken by the Thane Municipal Corporation (T.M.C.) against the illegal constructed buildings/houses.

4). Subject matter of Information:

The City of Mumbra and Kausa under the jurisdiction of Thane Municipal Corporation (T.M.C.) has been turned into a concrete jungle of unplanned illegally constructed buildings. No proper planning of the buildings has been taken care of.

As per estimate available, 99.0% of the city buildings are illegal, putting huge strain on the city infrastructure which is already crumbling due to poor planning by the Municipal Authorities.

The builder lobby is fearless of the Thane Municipal Corporation (T.M.C.), as no action is taken against them for constructing illegal buildings/houses. Each passing day, number illegal buildings are being constructed leading to chaos and daily fights between residents for water and other civic necessity.

In the event of a natural calamity such as earth quake, floods, fire incidents, there is a 100% chance of high number of casualties due to unplanned roads which will prevent the medical help/fire brigade from reaching the site of accidents.

a).  Please provide Year wise details starting from the year of 2000 to till date,  related to number of  T.M.C. Approved Buildings/Houses constructed in the city of Mumbra and Kausa, for which Completion Certificate/Occupancy Certificate has been issued by the Thane Municipal Corporation (T.M.C).

b). Please provide Year wise details starting from the year of 2000 to till date,  related to number of Illegal Buildings/Houses  constructed in the city of  Mumbra and Kausa, for which No Completion Certificate/Occupancy Certificate has been issued by the Thane Municipal Corporation (T.M.C).

c). Please Categorize the number of Legally Constructed Buildings/Houses (for which Completion Certificate/Occupancy Certificate has been issued by the Thane Municipal Corporation (T.M.C)) in the city of Mumbra and Kausa, according to the Number of Floors. Please provide this detail year wise starting from the year 2000 to till date.

d). Please Categorize the number of Illegally Constructed Buildings/Houses (for which No Completion Certificate/Occupancy Certificate has been issued by the Thane Municipal Corporation (T.M.C)), in the city of Mumbra and Kausa, according to the Number of Floors. Please provide this detail year wise starting from the year 2000 to till date.

e). Please provide the year wise details starting from the year 2000 to till date, regarding the action taken by the Thane Municipal Corporation (T.M.C.) against the illegal constructed buildings/houses in the city of Mumbra and Kausa.

f).  Please provide the name and addresses of the Builders/Developers/Individuals who has constructed illegal buildings/houses  during the period of year 2000 to till date, in the city of Mumbra and Kausa.

g). Please provide the name and addresses of the Builders/Developers/Individuals against whom Police F.I.R./Court prosecution has been initiated by the Thane Municipal Corporation under relevant acts, for construction of  illegal buildings/houses during the period of year 2000 to till date, in the city of Mumbra and Kausa.

h). If no Police F.I.R./Court Prosecution has not being initiated against any Builders/Developers/Individuals for illegal constructions of Buildings/houses in the city of Mumbra and Kausa starting from the year of 2000 to till date, then please provide reason for not initiating Police F.I.R./Court Prosecution.

h). Please provide the names and address of the Builders/Developers/Individuals who has been declared habitual offender,   for repeated illegal constructions of buildings/houses in the city of Mumbra and Kausa starting from the year of 2000 to till date. Please provide the details of the prosecution under relevant act initiated against these habitual offenders of illegal constructions.

i). Please provide details about the Officials of  Thane Municipal Corporation against whom prosecution has been initiated by the Thane Municipal Authorities for failure to act against the illegal constructions in the city of Mumbra and Kausa, starting from year 2000 to till date.

    Dear Sir,
    This is a very well Drafted RTI application.
    I would suggest two things here, that can be changed, if u can give me the ok for it

    1) The point #4 — Subject matter of Information:
    This is really not needed. The RTI Act does not really need you to specify the reason and I would suggest that we do not put this reason

    2) Can we reduce the time-duration of this RTI Application to something smaller to about 5 years. The current information asked is too much and we do not want the PIO to use that as an excuse and ignore/reject this application

      I agree with your suggestion for removing point no#4 and also reducing the time duration to 5 years.

      Please go ahead with your suggestion.

      Our ultimate goal is to expose the collusion of builders lobby with the Municipal Authorities in building illegal buildings.

    I have filed this RTI in the name of Mr. Ritesh Singh, by Speed Post. Speed Post reference no.: EM095893495IN.

    Further I have attached extra Rs.25 of Indian Postal Order, so that the RTI reply can be sent by Municipal Authorities by Speed Post. Necessary changes in the RTI application has been done to incorporate delivery of RTI reply by Speed Post.
