RTI for Hotel Flour Mill

Sub: Seeking information / documents under RTI Act 2005 – reg.

 

The following information / copy of supporting documents are sought under under the RTI Act 2005.

 

  1. 1.      Types of Business establishment eg.  Hotel, Flour Mill, Provision stores etc.  That is allowed in a residential locality under BBMP.
  2. 2.      The Guidelines  / criteria earmarked by BBMP for establishment of a Hotel, Flour Mill,  Provision stores, General stores, Departmental store in a residential locality under BBMP jurisdiction.
  3. 3.      The provisions or rules of the BBMP which permits for establishment of a Flour Mill in Residential Locality under BBMP jurisdiction.
  4. 4.      The dimension and conditions prescribed by BBMP to establish a Flour Mill.
  5. 5.      Is there any specific pollution norms for a flour mill for installation of Exhaust Unit which expels smell and dust particles emitted by the Flour Mill during its operation?
  6. 6.      Are there any specific pollution norms by BBMP which allows a Flour Mill to connect its exhaust pipe to the drain system, if so copy of such clear speaking orders / rules may be provided?
  7. 7.      Name, Designation, Address, Telephone / Fax number, Mobile number, Email ID of the Officer empowered to Trade License for establishment of Hotel, Flour Mill,  Provision stores, General stores, Departmental store in Ward No. 16, Jalahalli village.
  8. 8.      Are periodic inspection being carried out for checking any violations with respect to the commercial establishments listed in item 6 above, if so, the dates on which such inspections were carried since November 2007 to till date along with the name and designation of the officer performing such inspections.
  9. 9.      Were any violations observed during inspections carried out as in item 7 above?  If so, the nature of violations meted by commercial establishments and action initiated by BBMP for such violations.

    From the listed points I can understand that it is related to one flour mill in a residential area.

    I suggest some more points to your list pertaining to flour mill

    AS per law, a flour mill can be allowed, but with a permission from Commissioner and the capacity of flour mill should not exceed 7.5 K.W.

    Quote from Rules and Regulations:
    “A Flour Mill can be allowed in a Purely Residential Zone, as per D.C. Regulations for Gr. Bombay, 1991
    As per Regulation No. 51(xvi) of the D.C. Regulations for Gr. Bombay, 1991, in case of Purely Residential Zone (R-1 zone), apart from residential use, flour mills, with the special permission of the Commissioner, if (a) they are in a single storeyed detached or semi-detached structure, and (b) their power requirement does not exceed 7.5 K.W. each, is allowed.”

    In the RTI Application we can ask for:

    1) Copy of No Objection Certificate Issued by Industries Commissioner for that particular flour mil..

    2) Copy of Power Sanction Letter issued by Electricity Department for that particular flour mill..

    3) Copy of NOC issued by Department of Industries for installation of Machinery for that particular flour mill..

    Similarly flour mills are subjected to pollution control and also their location is based on sound criteria, if it was established before 1986, then there may be some relaxations.

    4) Copy of NOC issued by pollution control board for that particular floor mill.

    5) Copy of License issued to that particular flour mill.

    Please provide the name of the Flour Mill.
    Based on the Suggestion of Skywalker, we can redraft this application as per what Mr. Skywalker mentions above and combine it with your drafted Application, targetting this particular Flour Mill.

    Please do respond back within a week or so ..
    If we do not recieve any reply back before February 15th, I would be moving this RTI Application to the Unclear Category
