MCD budget

This is an application under Right to Information Act. Postal Order for Rs10 is attached as required. Queries are:

1. From April 2011 upto January 2012, how many tree-cutting or tree-pruning operations has MCD undertaken in Delhi?

2. In how many instances was there damage to neighbouring houses or other collateral damage during such tree-cutting or tree-pruning operation?

3. Provide list of recipients alongwith total amounts paid to who compensation for collateral damage to their property has been paid?

4. Provide list of instructions that MCD staff need to follow while on visit for tree-cutting or tree-pruning operation.

5. How many MCD staff were chargesheeted or penalised during the period for not having followed the given instructions during such operations?

6. How could a member of the public whose property has suffered such collateral damage claim compensation?

7. Inspite of asking onsite MCD staff to arrange the compensation, if MCD staff does not give adequate answers or tries to misguide, whether higher MCD authority will make house visit, after taking appointment, of a victim to apologise and to make the payment?

    * Copy of all permission / approval / NOC letters from issued by Tree Officer to MCD for removal of tree in Delhi during April 2011 to January 2012.

    * Copy of reports on numbers of trees removed in Delhi by MCD during April 2011 to January 2012.

    * Total Number of Complaints received on objecting the removal of trees during Apr 2011 to Jan 2012, and total number of such complaint towards which no action is initiated till date.

    I agree with mr anand’s draft where he has added mr skywalker’s points also. Will provide speedpost number.

    The origin of this RTI is what has happened to an old widow in delhi this month. MCD hunks came in a lorry and cut off branches of a tree. Some big branches fell on the widow’s house and broke the front lights and part of the wall. She requested the MCD staff to repair it, but they not only rejected her plea but were rude. Other neighbours intervened and then MCD staff said they will come next day to make repairs. Nearly four weeks have gone by. Is the widow expected to make rounds of MCD offices for what is her due? I made inquiries, and found that MCD does have a budget for collateral damage, but it is all siphoned off by MCD staff themselves by undertaking some sham operations near their houses.

    With this background, perhaps expecting MCD to make house visit and pay up no longer sounds so rhetorical.

      I agree with you, that it is absolutely necessary that the MCD official should atleast have the courtesy to come and pay their apologies. We all know, how arrogant these people are.
      But from a RTI application point of view, I do not think, that we can ask something like that.
      I would rather get all the relevant documents from the MCD and then file a PIL against them

      A punishment would satisfy me, than false pretense of apology by these arrogant MCD officials

      Thanks Malathy ji
      As mentioned above, let us first draft and fine tuen the request from the orginal requestor before filing it. If that means, we have delete few things from the original request, then it needs to happen, bcos there is no point in just sending things to the PIO and giving him excuses to “throw it away” by rejecting the application.

    I have faced a strange problem in posting this. I was in delhi so went to a post office in delhi. Consignee address is also in delhi so speedpost charge should be Rs 12. I have posted similar letters to other PIOs in the past. But this time this post office took the stand that not only Rs 12 will have to be paid, but in addition, I will need to affix stamps of Rs 25, so that “just in case” the PIO refuses to accept, then the letter will have to be sent back to west bengal kharagpur, so for that eventuality the additional Rs 25 stamps to to be put now. I have sent a complaint/ query to speedpost email, and will try also at another post office today, but meanwhile does anybody has any comment on this demand by the post dept?

    File a complaint with MCD deputy commissioner followed by RTI. DC will surely ask MCD Engineering works dept to rectify the damage followed by RTI.
