i (virendra gupta) resident at 345, sharad nagar, tarsali road vadodara 390009 gujarat. i want to know regarding the caste certificate of mr. rajaram s/o nagulal vaishy resident at 2, malipura ujjain and retired from the collector of ujjain. actually i want the information for the “first five pages of the service record” of mr. rajaram s/o nagulal vaishy but if it is not possible the please provide me the information regarding the caste certificate on which basis mr. rajaram s/o nagulal vaishy had done the job in collector office ujjain and retire from the collector office ujjain.

i have written as per rules of r.t.i but collector office have said me that because of third party collector office can not provide you information.
then i was gone for the first appeal in first appeal mr. rajaram s/o nagulal vaishy has given the objection letter to the first appealant officer so that collector office has refused me to provide the information because mr.rajaram s/o nagulal vaishy’s objection letter.
then i was gone for the second appeal bhopal in the month of april 2011 but till the date i didn’t get information or any answer from second appeal. i have also written the reminder letter to the second appeal bhopal, but till the date i did’nt get any answer of information from second appeal bhopal. i don’t know what to do now please help me.
i am attaching all the answers which i have received from the collector office, first appeal and second appeal.

3. You can file this RTI to ask the certified copy of caste certificate of that person only
sir;
first time i have sended r.t.i application for the service record at present my same application is pending in second appeal bhopal since last 9 months.
then i have written new r.t.i application for the caste certificate of mr.
rajaram s/o nagulal vaishy but this application is also rejected by collector office
ujjain.
i am attaching the new r.t.i with this reply to you which i have sended for the caste certificate of mr. rajaram s/o nagulal vaishy. please go through it and give me suggestion what to do next and how can i get the proof of caste certificate of mr. rajaram s/o nagulal vaishy. sir i have attached the r.t.i application which i have sended to collector office ujjain and the answer which i have received form the collector office and first appeal collector office.

Hi, service book is not a personal record,
i will send u decisions of cic in this matter soon
Regarding service book:
1. The Service Book of a Government Employee cannot be treated as a personal file. If a person is appointed in a Public Authority then a ‘Service Book is maintained with his name which contains all the information about the employee such as date of appointment, date of birth, educational qualifications, transfers, promotions, increments… and all other details which are in-connection with his employment’ which fall in public domain.
2. When a person “is holding a public office, getting salary from the public exchequer and discharging public functions in a public institution, therefore whatever documents he has submitted in pursuance of his appointment or after his appointment to public office in a public institution falls in public domain” and whatever files, books are maintained in connection with his employment are in public domain and maintained by a public authority, further the information which is held with a public authority should be provided as per sec 2(f) read with sec 2(j) of RTI Act, 2005.
3. So providing the Service Book of a Government employee cannot be held as unwarranted invasion of privacy and whatever files, certificates, books of a government employee which are in-connection with his employment professionally cannot be treated as third party.
4. However, while providing a copy of the service book, the Public Information Officer shall remove those portions of the Service book which contain any reference about his family, health and other such personal details which doesn’t deal with his employment professionally.
thanks to guide me i request to send me the decision of cic as early as possible regarding service record of government employee. please support me regarding this matter because collector office of ujjain always denying me since last two years to provide me the information which i am demanding from the collector office.
and another thing is that since last 9 months my second appeal application is pending in bhopal but they are not giving me any answer from second appeal bhopal. i have attached the letter which i have received from the second appeal bhopal.

I have attached some decisions of CIC regarding service book and certificates, select them as per ur requirement.
Go to Central Information commission website and search for service book and caste certificates, u will get some more decisions.
Apply new RTI’s quoting the reference of CIC decisions. U can again send new rti’s to collector office, there is no restriction for it

Use these judgements when ur second appeal comes for hearing.
U can send these judgements to second appeal pending with information commission, send as ADDENDUM TO SECOND APPEAL, quoting ur second appeal number which they had sent to you.
When filing fresh rti with Collector office, quote the reference of judgements.
Yes u can write it in ur new rti application, mention it as Note: and write the four points.
