REQUEST FOR DETAILS OF REFUSAL TO GRANT H.R.A

Pre-Logue:

Ce ntral Government gives HRA to tis officials on the conditions that,the person/Spouse has not been allotted a government accommodation at the same station.

 

It is also mentioned clearly in the HRA rules that production of rent receipt is not required for HRA.

 

The case:

Shri S.K.Mishra ,joined as an Accountant in the PAO(Pay and Accounts Offie), CPWD, SZ, Chennai in September-2001. As neither him nor his spouse was allotted any government accommodation in Chennai or subrubs, he was granted for the first month by the then Sr.Accounts Officer , Ms. Swathantralakshmi.

(The spouse of Mr.Mishra was allotted a government quarter 60 kilometer away In Kalpakkam and Mr.Mishra managed the distance  with great difficulty added with the language and food problem. He also had to make temporary arrangements and rent lodge rooms when it was not possible to commute. In office he was one of the most sincere workers and handled whatever job assigned to him)

The next month, the Deputy Controller of Accounts , Mr.Dilwar Huusani, joined and had an introductory talk with Mr.mishra.

After that, the HRA was stopped and the HRA  for previous month was deducted from his salary. he was neither given any notice nor any intimation.

Away from his own place, alone and fearful of the deputy controller, Mr.Mishra continued working  without his justified income paid to him. It resulted in enormous self destruction and currently he is undergoing treatment for stress induced diseases( Transferred from chennai 5 years back)

 

The information sought under the RTI act 2005 is

1.Why was the HRA of Shri S.K.Mishra, stoppe d though ti is clear as per the rule that HRA is admissible only with respect to the headquartes, without insisting on rent receipt and only if the official /spouse has not been allotted a quarter in the same station.

2.What were the orders passed by the competent authority and whether such order was contested. If not , why Not?

    1. For the first month both are entitled HRA.Both( husband and wife) at separate duty stations.
    2. For second month Mr Mishra would have taken permission to stay out of duty station. When out of duty station he is staying in governemnt accomodation and incurring no expenditure on lodging in duty station- so no HRA.It is harsh interpretation but the controlling officer within his right to do so. If Mr Mishra had commuted on weekends he would have been eligible for HRA.
    3. However on permt transfer both husband and wife can claim transfer grant with restn on luggage.
