Pay for Ex Service Man

Dear Comrades,

Mine is a different and extraordinary case.   I am an Ex-Sergeant from Indian Airforce, retired from active service in the year 2005, April after 20 years of active service.  However I have joined the State Bank of India only in 2010 after serving in private sector.

My contention is that while the pay is protected for exservicemen in SBI, payment for those retired in pre 6th commission and joined post 6th Pay Commission is yet to taken up by the Banking sector though there is a clear OM issued by GOI (No. 3/19/2009-Estt. (Pay II) Ministry of Personnel, Public Grievances & Pension, Department of Personnel & Training  dated 05 April 2010 which clearly mentions the provision as per 3 (v) in the OM.

It states “ Fixation of pay of personnelfofficers who retired prior to 1.1.2006 and who have been re-employed after 1.1.2006: In the case of personnel/officers who had retired prior to 1.1.2006 and who have been re-employed after 1.1.2006, their pay on re-employment will be fixed by notionally arriving at their revised basic pay at the time of retirement as if they had retired under the revised pay structure. This will be done with reference to the fitment table of the Defence Service RankICivilian service post (as the case may be) from which they had retired and the stage of basic pay at the time of their retirement.”

Can anyone help me out in getting me the justice.  What should i do further.

    I have my friend, retired in 90′s and off late joined a bank, hardly two months bank. On discussing with him, he talked of a policy that would made him eligible for a payment as per sixth pay commission. Either u will have to wait for another four-five months to see his next step or u urself can take up this issue on a channel as deemed fit.

    File an RTI urself or tell any of ur friends to file an RTI seeking info on those personnel who retired pre 2006, joined later on and been fixed payment as per sixth pay commission’s declaration.

    My case is also same. I too retired in 2005 April. Today I got appointment letter for SBI. I don’t know what to do.Can you please help by guiding me. I am in a dilema whether to join or not. My last pay was Rs. 11500. So i get the same as a fresh clerk which is 13500. Now ex-servicemen who retiring is getting 30K+
