RTI APPLICATION TO RTU KOTA FOR VIOLATION OF RTI Act and SC ORDER
Rajasthan Technical University rejected our plea/prayer for disclosure of answersheets or OMR sheets to students for semester Exams.
In the reply on each student RTI they stated that ordinance no. 157-A-16 of University and as per the order of CIC information related to answersheets and OMR sheet can not provide under RTI Act 2005. All these things happened after the honorable SC Judgement came on issue of answersheets. When we made media pressure then they released through press that they will soon create a new gugidelines on this issue in 15th october 2011 meeting. But in meeting nothing happened. the whole story is captured by National level news paper on my RTI. Please look as below…

Subject : Application for obtaining information under Right to information Act 2005.
Sir,
I would like to apply for the following information under Sec 6(1) of the RTI Act 2005.
1.) Daily progress made on my application till date of your reply.
2.) Names, designations and office addresses of the officials with whom my application was lying during this period and date wise period with each official and details of action taken by him/her.
3.) Please provide a copy of minutes of BOM ( Board of management meeting ) dated 15.10.2011.
4.) Please provide the information about start time and end time for meeting as well as the list of participants, if money paid to participants to attend and what were the expenses for holding the meeting as mentioned in item no. 3
5.) Please provide a copy of proposal letter/recommendation sent by examination department to the VCs office for issue of disclosure of answersheet and OMR sheet to students under RTI Act 2005 as stated in press released of Rajasthan Patrika kota dated 18.10.2011.
6.) Please inform about the number of RTI application recieved by University during the year 2010 and 2011 by students under the RTI Act 2005 in which students requested for inspection or photocopy of answersheets and OMR sheet as per record.
7.) Please provide information about the number of second appeal hearing scheduled by SIC/CIC on the issue of answersheet or OMR sheets, copy of decisions.
8.) Has University followed the order of Honorable SIC/CIC.
If yes, Then how much students seeked answersheet or inspecation till year 2011.
If No, Then reason under Sec 4(1)(d) about your administration decision for not to provide answersheet and omr sheet to students after the SIC/CIC decision in this regards.
9.) Name, Branch, Roll no.,semester of each students whose answersheets and OMR sheets are provided by University till year 2011.
10.) Please provide copy of all ordinances applicable for B.Tech 2006 batch.
11.) please provide me file noting and action taken report along with your reply. Also please mention the ammount of additional fee for information cost as per RTI Act 2005.
Preferred language in which information is desired is English. I will collect the information in person on intimation.
In case any of the above-asked information is held by or related to another public authority, you are requested to transfer the application or such part of it as may be appropriate to that other public authority with an intimation to the undersigned (Section 6(3) of Right to Information Act, 2005).

बिंदु संख्या 5 एवं 10 में दी गई सूचनाये बिलकुल गलत है , इस मामले पर प्रथम अपील कि जानी चाहिए. यहाँ सुप्रीम कोर्ट के आदेशो कि पलना भी नहीं हो रही है, सुप्रीम कोर्ट ने सिविल अपील 6454/2011 Aditya bandopadya and others v/s CBSE and others के प्रकरण का निपटारा करते हुवे सभी परीक्षा लेनी वाली संस्थाओ को परीक्षा व्यवस्था को पारदर्शी बनाने एवं विद्यार्थी हित के लिए उतर्पुस्तिकाओ को दिखाने एवं उनकी प्रमाणित प्रति प्रदान करने के निर्देश दिए थे , जबकि इस मामले पर राजस्थान तकनीकी विश्व विध्यालय सूचना देने एवं उतर्पुस्तिका दिखने को तैयार नहीं है . आर टी आई एक्ट में पहले से ही सूचना के लिए ओर दस्तावेजों कि प्रति के लिए शुल्क तथा निरिक्षण के लिए नियम निर्धारित है फिर भी ये सरकारी विश्व विध्यालय ही सरकार के बनाये हुवे आर टी आई कानून एवं सुप्रीम कोर्ट के आदेश कि धज्जिया उड़ा रहा है .
सुप्रीम कोर्ट के आदेश पर भी चर्चाए कर रहे है ….जो कि गलत है . इसका अधिकार तो हमारी सरकार को भी नहीं है .
अगर एडमिन चाहे तो सुप्रीम कोर्ट में एक अवमानना याचिका भी प्रस्तुत कर सकते है . जो कि एक बड़े जनहित का मुद्दा होगा .
इसी मुद्दे पर में ओर मेरे कुछ साथी हाई कोर्ट जयपुर से विश्व विध्यालय के विरुद्ध प्रकरण में कॉपी देखने के निर्देश ले चुके है . विश्व विह्द्यालय को अगले १० दिनों में इस आदेश कि पालना हर हाल में करनी है अन्यथा अवमानना याचिका प्रस्तुत कर दी जायेगी
पूर्व में मेरे द्वारा लगाईं एक आर टी आई भी यहाँ पर सलागन है …जो मेरे किस मित्र के नाम पर लगाईं गई थी
बिंदु संख्या 10 के जवाब में उस आर टी आई पर वि वि ने यह कहा था कि बी.टेक के ओर्दिनांस अभी विचाराधीन है …जब बी. टेक के नियम ही नहीं है वि वि के पास तो फिर बी.टेक कि डिग्री किस आधार पर करवाई जा रही है ….सोचने वाली बात है …ओर राजस्थान के लिए तो शर्म कि बात है …
