Help me how to make application for demanding penalty?
I have filled RTI at Ahmedabad Municipal Corporation on 3rd April,2012 and as per 30days time limit, I should get reply on or before 3rd May,2012.
But I had not receiver reply, hence I filled 1st Appeal on 25th May,2012 and within 2 days I received reply.
Now I want to make application for demanding penalty for total delay of 25 days (i.e. from 3rd may to 27th may). Now for that whether I should file 1st appeal or any other action required? How to draft application for the same. Kindly help me.

Madam,
1. You can file the complaint with State Information Commission ( under Sec 20(1) of RTIA 2005) with a copy to FAA, Ahmedabad Municipal Corporation. Attach copy of your RTI application, proof of posting and copy of the repy from CPIO.
2. Please note 30 days do not include postal delivery time/delay.
3. Also option to provide reasonable cause for delay still exists with CPIO.
What is the copy of FAA? Is there any time period within which I should make a complaint to State Information Commissioner?
Can you please provide me application pro-forma to make complaint with State Information Commissioner?
1. It is copy to FAA or the copy of your appeal to the First Appellate Authority of Municipal Corporation.
2. As per RTIA 2005 90 days or earlier from date of receipt of reply from FAA.
3. Same as RTI application. It must have a paragraph heading – Relief Sought from State Information Commission. Under this paragraph state- It is requested that in accordance with Section 20(1) of RTIA 2005 a penalty be imposed on the CPIO for the delay in providing reply to the applicant.
