Illegal possession of land by uncles….
My mother has total 7 siblings including 3 brother & 4 sisters. After death of her parents, her three brothers has possessed all the ancestral properties without the consent of the sisters. Which is illegal but my mother and her sisters has no idea how all the property is under the name of their brothers without their consent. My mother and her sisters are really afraid of her brothers as they are very influential people so they can not go for a normal RTI or court case till they have proper proof of this matter. Please help….Following are the details……..

We need some information under RTI, After Death of Mr. Om Prakash Sharma & his Wife Shanti Devi ( R/O Village Om Nagar Dhani, Post office-Village Budhera, Dist. Gurgaon, Haryana ), all of their ancestral land and property which was under both of their name has been transferred to their 3 son’s name(Ashok Sharma, anil Sharma & Akshay Sharma) with out the consent of 5 of their sister’s.

In my opinion this matter is much complicated to be covered by RTI. You can have information that are there in records. Since you are already know ancestral property has been transferred to your uncles, same information you will get with RTI (if its true) but for that you have to give details of property to know about the ownership.

Thanks Ankit for your prompt response. Yes you are right up to an extent. Every one will think the same way , you did to start with.
But the problem is something else…. My uncles are very influential , very well political connected & potentialy dangerous for my mother and her sisters. All the sisters are afraid of them…. You know in haryana how the things are and how they treat their daughters.
More over when we tried to get the documents, we had to go to the local “Patwari” for the records. We found that the office space is given by my uncle to the patwari in his own haveli and both are good friends…. So it was not practically possible. My mother and her sisters decided to file a RTI & once we have concrete evidence, we can go to the court…..
Lets wait for more suggestions because i dont know how to what information to ask from the office. Because in my opinion additional information is required to help the PIO in searching information in the records. There would be many files with the same name mr omprakash and mrs shanti devi
Thanks for your reply……. I” ll try to get more information if required. But village ” om nager dhani” in gurgaon dist is a small village with only 300 voters and no other couple named Om Prakash sharma and shanti devi there.
If it is a small place one can ask under RTI the list of all property owners in that village with survey numbers under RTI.After getting the list, the details of specific property also sought by other RTI.Here one have to use more than one RTI to get result.
