PURCHASE OF FLAT AGREEMENTS SUBMITTED FOR REGISTRATION WITH REGISTRAR OF ASSURANCES AT BANDRA KURLA COMPLEX  VIDE Vide Receipt No 4649/86 dt 22/8/1986 AND 4650/86 DT22/8/86 NOT YEAT RECEIVED BACK BY US.

INSPITE OF WRITING SEVERAL LETTERS THE OFFICE AT BANDRA IS SHUNTING THE MATTER WITH FALSE INFO THAT THE DOCUMENTS WERE SENT BACK TO THE PARTY BY COURIER. FINAL LETTER ENCLOSED FOR YOUR INFORMATION AND NECESSARY ACTION

Dear Sir;

Non Receipt of  Purchase of Flat Agreements  submitted for Registration

                          Vide Receipt No 4649/86 and  4650/86 both dt 22/8/1986

 

This has reference to  your letter dated 24th June 2011 in response to our reminder  letter  dated 10th May 2011  as regards non receipt of Original Agreements for purchase of  flats   submitted to the  Registration Office at Mumbai vide above referred receipt Nos and subsequent demand for additional stamp duty which was cleared  vide Nagar Rachnakar, stamp and valuation, Mumbai letter Ref No: Nagar/Mumbai-suburb –A/Ambivali/86/9826/841 & 848 both  dated 13th January 1995 certifing payment of additional stamp duty of Rs. 18,370/- Penalty 250/- and Registration Rs 1720/- in respect of each document along with Challan  Nos 10 &11 copies of which was forwarded to you for information and necessary action

 

We regret though over twenty five years have lapsed  till date we have not received our receive our original agreements which is a valuable document and as the Office in Charge  you  are duty bound to ensure that the Agreement is delivered to the ownera. We are not interested in internal correspondence exchanged within your departments  by you for last over a year but are interested in the Original documents which are not yet delivered back to us by Registered Post as per the practice of your Office. We observe that you have issued several reminders but we fail to understand are sure that unlike us there are thousands of stamp duty payers who have tendered their documents for registration and have not received back till date. We sincerely once again request you to personaly look into the matter, trace the documents  and ensure that both the Original Agreements are returned to us by Registered Post at the earliest else we will have to invoke the R T I Act.

    There is lot of corruption in this office. Some lawyers are undetaking this work for fee but however, even they have to pay to currupt officers to get the work done. Filing an RTI will teach them a good lesson.

    Hello sir, To draft an RTI application, we need the following from you;
    1.Pl upload scanned copies of your latest reference to the IGR and his reply for that communication.
    2.Why the issue was not pursued for nearly 25 years? Any specific reason.
    3. If the original documents are really lost, did you consider taking certified copies of those documents which is as good as original for all purposes.

      Dear Sir
      Here is the reply from RK on your queries .. .
      Hi Anand,
      I have gone through the letters of the applicant to the IGR regarding the
      Registered Agreement. It is clear from those letters that eh has not received the registered
      Agreement from the Registering Authority. Through an RTI application we may ask the
      Registering authority about the status of the Registered Document.
      There is another alternative. The applicant if he has at a later stage completed
      the purchase formalities, he would have registered the sale deed at the same
      registering authority. If this has happened, the earlier Agreement has no relevance. In this case
      he can obtain a certified copy of the earlier agreement. from the registering authority.
      You may inform him and get his response on this.
