I write to you under RTI ACT .
I request you to provide me the following information :
1. A copy of the Trust deed.
2. Any orders of the High Court applicable to this Trust which have been obtained by you or any other party.
3. Copy of the High Court order dated 9th February 2000. and copy of the petition/application on which this order was made and all other papers referring to this order.
4. Names and addresses of the Committee Members of School
5. Copies of any scheme/project etc. for the redevelopment of the school property at Royd St.#
6. Statement of accounts of the Trus.
7. Statement showing the Income from the property at No1, Ashutosh Mukherje Road (Old School property) from the date of signing the first lease with Elgin Properties till upto date financial year.
The information is requested under RTI Act.

I request you to provide me the following information about ESTATE OF D.A. DAVID/ DAVIDIAN SCHOOL TRUST:
1. Certified copy of the Trust deed.
2. Certified Copies of orders of the High Court applicable to this Trust which has been obtained by you or any other party.
3. Certified copy of the High Court order dated 9th February 2000 and Certified copy of the petition/application on which this order was made and all other documents referring to this order.
4. Names and Addresses of the Committee Members of the School
5. Copies of any scheme and/or project for the redevelopment of the School Property at Royd Street

7. Statement showing the Income from the property at Number 1, Ashutosh Mukherjee Road (Old School property) from the date of signing the first lease with Elgin Properties till 30th September 2011.
I doubt whether this School is a "Public Authority" under the RTI Act. Ie.,it must getting substantial funds from Govt or estblished by Govt. Since this is a private trust,we have no right to any information under the RTI Act. Pl checkup the position before filing the application.

This is not a case about a school. This is a request to a Public Authority : which is the Official Trustee, West Bengal. No, it is not getting any funds from the Govt. As you can see the request is to the Official Trustee, Govt. of West Bengal, which is under the Judicial deptt. of WB. Govt. Yes we have a right under RTI to get records from ANY govt. deptt. which is holding the records.
The list of filed RTIS is not working. You can access only one page. Admins please look into it.

Thank you. As the Govt. is the sole trustee of this estate, therefore, the Govt. is duty bound to reply to the RTI request.
I am glad to see that you have sent the RTI to the Official Trustee.
This Govt. of West Bengal Office manages more than one thousand estates including the Murshidabad Estates (Murshidabad Palace too.) This office controls/manages huges mansions, properties, palaces, land, and it is the head office of all the promoters/dalals of Calcutta and West Bengal.The employess are a very arrogant lot, who being tied up wiht promoters/dalals are also VERY DANGEROUS people. If anyone asks too many questions, that person will wil receive knocks on his door from gangsters, police (gangsters in uniform) etc. Only RTI groups like yours can find out the truth about this office. Please deal with the other requests too. Since this office manages the estates/properties for the benefit of charity/the poor and the ill too, your service will be a service to humanity.
It is only expected if you have read my comments about this corrupt deptt. RTI covers every govt. authority/deptt/person. so therefore refusal is illegal.
We should get more advice from other RTI groups about this refusal.Please follow it up.
This RTI Application was Received by the Addressee and not Accepted which is illegal (images attached). Don’t worry, we will follow-up this case with the State Information Commission. However, please do check and confirm whether the Official Trustee is the Public Information Officer that is whether he/she is the correct person who should accept the RTI Application.

Yes, we know that the RTI Application should usually be routed through the PIO. It is easy to find out the PIO once we know the Department/Ministry that this Application pertains to (which unfortunately isn't yet clear to us for this Application).
Of course, we will follow up this RTI Application. We just want to request you to supplement us with information in case you come across it anywhere.
What if we do not know from which department/ ministry seek info where to apply ???
This OFFICIAL TRUSTEE is under the Judicial Ministry/Deptt. Writers' Building. I think it is better to send it to Judicial Secretary.
We will File this RTI Application soon with the Judicial Department of Government of West Bengal.
As this Official Trustee deptt. is very obstructive in any request for transparency have you plans/advice etc. ready for an appeal ? As I am very, very sure they are going to refuse the request. This deptt. is "managing" over one thousand "trusts and estates" which are connected to or concerning thousands of buildings/lands all over Calcutta,Bengal and India. And therefore this deptt. is a milk cow to political parties ensuring underhand money reaches the party through all the illegal deals done on these trust properties. I hope you are getting prepared for a long fight.

It takes time to research and refine to make it a presentable RTI and then to file it, We do not have enough people who are involved in filing RTI's we have people in other areas but we face a crunch in this one, dont worry we will file those RTI's soon.
