Plot No 90 purchased against Sr No 401/1 in Makhmalabad, Nashik in January 2008

Dear Sir,

I can’t say whether anonymity is required in the present case or not.  You may please decide the issue after reading what I have to say.

The captioned plot was purchased by me from Aniruddha R Shah of Subhadra Properties Pvt Ltd.   I was promised that I would receive the 7/12 extract within two months.  I have not received the same till date.  Last year I sent an RTI application to the Nasik Municipal Corporation asking them for the reason in delay.  The Talathi replied but only stated that the developer had not fulfilled certain conditions set by the NMC, but no clarification was given as to what these conditions were.  I also made a complaint against the developer with the Police Commissioner of Nashik.  My husband and I were summoned by a Havaldar Ganpat Kakde for a meeting with the developer in his presence.  The Havaldar wrote out a report of the proceedings wherein the developer had promised to settle the matter by end April 2010.  When this did not happen we requested the Havaldar for a copy of the report, which he has refused to furnish, saying that he has mislaid it.  According to the developer the NMC is harassing him, but in spite of the fact that he cannot furnish the 7/12 extract to plot purchasers, he continues to sell the plots in this survey number which total over 100 in number.  I have also approached The Times of India, Nashik to highlight this matter, but after agreeing to do something about it, the editor has suddenly chickened out.

I would like to know how many people have purchased these plots and whether they have also been denied the 7/12 extract.  You will agree that without the extract the plots are worthless, since we can neither build on them nor sell them and there is absolutely no returns on our investments.  These are NA plots so basically there should be no problem.  Is this some sort of a scam since I am unable to get a proper reply from either the developer or the NMC and even the havaldar has not cooperated by furnishing a copy of his report?  And why has the editor of the Times of India also kept mum on the issue after offering to help?

Regards,

Shireen Bharucha

Hi Shireen, What I think is that this is private project. There is no hand of govt official in this. You have to go to police again or file a RTI with Nasik police demanding answer related to your earlier report with Hawaldar. File this RTI or police complain in your personal capacity.

In case of any issue, please revert back here. We’ll be happy to help you.
