RTI for Oil prices rise in India

Matter:

Issue between Shipping Corporation of India, ONGC and Customs

Issue:

Customs has seized / stopped / confiscated 3 ships from ONGC and few other ships from SCIL citing non payment of  duty for the spare parts replaced while carrying out repairs / maintenance work at dry docks abroad (Dubai, Srilanka ets)

 

They have asked for documentary details of repairs carried out abroad since last 20 years and forcing them to pay duty. The ships are stranded since 2 months incurring huge loss to the extent of Rs. 1.5 crore / day / shop.

ONGC offered to issue blanck cheque and requested Customs to release ships pending investigation to avoid loss. Ironically all the 3 Organisations are the GoI undertakings.

(When ships go for repairs abroad, Customs clearance or conversion is to be done by Customs Dept. the ships also has to inform Bombay  Port before departure. Now Customs is asking 20 years back dated repair details and repairing expenses at dry docks abroad. Ships seized on 21st Sept till date)

Ships seized from ONGC are: Samudra Nodhi, Samudra Prabha, Sagar Sadhni and about 20 ships from SCIL. Exact details to be known soon.

Possible reason for the above Issue:

Award of contracts to foreign shipping lines and earn commission.

Points to be raised in the RTI

  1. How many ships belonging to ONGC and SCIL seized and grounded in last year.
  2. If so under what provision of law?
  3. Whether any FIR lodged?
  4. Any action has been taken against the concerned officers?
  5. What was the quantum of loss to the organisations?
  6. Reasons to seize the vessels?
  7. Who instructed such actions against the Shipping lines and ONGC?
  8. What is the extent of penalty imposed on the ships?
  9. Contracts awarded by ONGC and SCIL?
  10. How much amount, the Customs is demanding from ONGC and SCIL?
  11. Show cause notice / Demand Note by Customs to ONGC and SCIL for grounding the ships?

    Please confirm, whether this RTI application should really go to the Customs Department of Mumbai Zone I or Mumbai Zone III.

    The information that you have provided is for the Deputy Commissioner Of Customs for Mumbai Zone III
    If you check this link .. the PIO for Customs Zone III is different.
    Its always better to file this to the right CPIO, to avoid delays

    We have received the reply from the Office of the Commissioner of Customs(Airport).The reply says that “this office is not connected to seizure of any ships.Hence the information sought by you in your application is NIL, as far as the Commissionerate of Airport Customs, C.S.I. Airport, Mumbai is concerned.”

    He should have transferred this application..

    Send him a letter that as per the act he is required to transfer to such dept, and say that failing which you will file a complaint with CIC for negligence on part of PIO.
