3)       Subject matter of Information:  The Ministry of Environments & Forests / Judiciary  have granted ‘Clearance’ to Phase 1 of ‘Lavasa’ Project  in Pune, because political pressure from        Mr.Sharad Pawar (MoAg..-NCP), who went so far as to meet Mrs. Sonia Gandhi and the P.M. to get anassrance that the Prject would be cleared at the earliest because he had a stake in it. Lavasa is situated in the midst ofVirginForest area, and the Promoters / Builders /  Politicians had flouted all regulations in getting it started. In stark comparison, the Bhandup / Mu/lund/ Thane belt along LBS Marg in Mumbai was declared as ‘Forest Land’ in about 2002, although the area was already developed and many factories sanctioned by the State Govt., were already functioning for decades,. A stay has been put on all Construction Activities in the belt. Lakhs of people, who had booked flats in the area, by investing their hard-earned money, have been affected. The case is languishing in the Courts for almost a decade. Still no resolution is forthcoming.

4) Period to which the Information relates:          2005 to 2011

 

5) Description of Information required:

 

a) On what basis ‘Lavasa’ was able to get clearance, so quickly, as compared to our case, which has been languishing in Courts, for  almost a decade, in  both of which   MoEF/ Judiciary are  involved?

b)How many more years will it take to settle our matter without resorting to Political clout ?

c) After my retirement I had invested all my retirement benefits in investing in a flat and the Building was almost completed and ready for occupation. I had also paid Registration Charges & Stamp Duty on my flat. I am now a 72years old Senior Citizen. Is there any hope that I will live to see the day that I will get occupation of my Flat?

d) Kindly, if possible, advise me what I should do in order to expedite the matter, as I do not have any Political support

    Dear Max,

    I respect your feelings and feel even on this issue. Under RTI perview, you can ask for the information about two thing, but cannot compare two things. So this will not be possible to file an RTI for this reuest in current manner.

    For this case, you have to file two different application asking the grounds on which Lavasa project has been cleared and communication done in the matter between MoEF officials. Also you can refer judiciary review of the matter. You cannot name Mr. Sharad Pawar on the basis of media reports. You can check about meetings and communication between him and other leaders, which will give Minutes of Meeting and letters corresponded.

    For second case of yours, same you can check and ask for status & grounds on which it is stayed. I have tried to address all your concerns and in case of any issue, please revert back.
