Sub: Request for the justice by the CIC,New Delhi – reg

Ref: My complaint in the 2nd appeal no. CIC/WB/A/2007/01279

about the misleading attempts of the AA,SSC,New Delhi – reg

Sir,

As a responsible citizen of India, I have exposed some irregularities using the RTI tool.

In fact, only after I preferred my above mentioned 2nd appeal in the Hon’ble CIC,New Delhi, the Appellate Authority, Staff Selection Commission (Department of Personnel & Training), Lodhi Road, New Delhi had supplied me the partial information which the same was denied initially stating that ‘all the records were weeded out’. I am at loss to understand how the weededout records were traced after my 2nd appeal in the CIC,New Delhi.

A the said partial information contains wrong and misleading information, I had requested then Hon’ble Chief Information Commissioner Mr. Wajahat Habibullah vide my letter dt. 4th February 2009 to arrange me the correct and certified information during the scheduled hearing on 11th February 2009.

The Hon’ble CIC,New Delhi has directed the Appellate Authority, SSC,New Delhi to dispose my letter dt. 4th February 2009 within 15 days. But, till date, I have not received any information based on the ‘Decision Notice’ dt. 11-02-2009. May I request you to kindly see the said Decision Notice in the following URL:

As there was no action on the ‘Decision Notice’ of the Hon’ble CIC,New Delhi, I had made several representations to the Hon’ble CIC,New Delhi along with a request to the Chairman, Staff Selection Commission, New Delhi vide my letter dt. 28-05-2009  1ST REQUEST LETTER SENT TO CHAIRMAN SSC NEW DELHI.

To my surprise, the Appellate Authority, Staff Selection Commission has opted to mislead the Hon’ble Central Information Commission as well as the RTI applicant vide her letter dt. 16-06-2009 stating that  the authorised representative has stated during the hearing on 11-02-2009 that  ‘ all the information sought by you had been received and sought only a notifed copy of recruitment rules. CIC vide letter dt. 11-02-2009 had directed the Appellate Authority to dispose of the appeal within 15 working days from the receipt of their decision. ‘

Unfortunately, the Hon’ble Central Information Commission, New Delhi has not initiated any disciplinary action on the said Appellate Authority, SSC,New Delhi even after my complaint with documentary support ie. Decision Notice dt. 11-02-2009, AA’s letter dt. 16-06-2009.

I request you to kindly look into matter of misleading attempts of  the public authorities by comparing the above said Decision Notice, my request letter to the Chairman, SSC,New Delhi  and the AA’s letter dt. 16-06-2009 2ND IMPORTANT LETTER RECEIVED FROM AA SSC ND .

Of course, we have come across many such incidents but those news reports were of the Public Authorities who have misled the RTI applicants. But, this instant case of misleading the Hon’ble CIC and the silence of the CIC is really alarming.
