I do hope you have received my email dated 24th October, 2011, sent to the Hon’ble Minister for Co-operation with a copy to you.
It is almost a year since Smt. Sonia Gandhi handed over the reigns Maharashtra politics after the Adarsh CHS scam broke out. It was at that time looked upon you,  with your reputation of clean image, to eradicate corruption in the Public domain. However, nothing has changed since.
What I am reporting to you is a scam brewing in the Co-operative Housing Sector under the jurisdiction of the Deputy Registrars of Co-operative Societies in Mumbai.
You may be aware that in order to bring fairness and transparency in Redevelopment of Co-operative Societies the Government came up with a circular dated 3rd January, 2009 under section 79A of the MCS Act. The Government intended while issuing the circular that the Officer appointed by the Dy. Registrar to observe and oversee the proceedings of the Special General Body Meetings (SGBM) held to select the Developer by the co-operative Societies for the Redevelopment of the Society Building.
Although the power vested with the Dy. Registrar as per the Govt. Circular is to be an observer and not as an approver, however, in actual practice, the Dy. Registrars have assumed unprecedented powers to arm twist the hapless societies by demanding Rs. 15,000/- to Rs. 20,000/- per member for seeking the appointment of the Authorised Officer and approving the Redevelopment project of the Societies.    
If  one assumes on a conservative estimate that five thousand (5000) societies having 20 flats are going in for redevelopment in any given calendar year the amount of bribe works out to approximately Rs. 200 Cr. Although I am from ‘P’ Ward and referring to situation as such, the story for other wards remain the same. It is estimated that in the past two years Rs. 50 to 75 Cr have been extracted from the developers/societies by deliberately misinterpreting the provisions of the Govt. Circular dated 3rd January, 2009.
This is indeed a very serious matter concerning corruption which requires your urgent and immediate attention.
At this moment I am not disclosing the facts of this matter to the Press or the members of India Against Corruption.
I am a Senior Citizen and a well wisher of the Congress Party.
What, as a CEO of Maharashtra, I expect you to do is to depute your Officer to see me at a mutually convenient time and I will pass on to him all the details, after which you may order an investigation, take corrective steps and punish the errant officials.

Sub: Request Information under R.T.I. Act 2005.

 

This application is made under section 6 of R.T.I. Act 2005 and Rupees 10 court fee stamp is affixed herewith.

 

Background:

 

In order to streamline the procedure for re-development of Co- Operative Housing Societies in Maharashtrathe Govt. issued a circular no.S.GY.2007/L.No. 554/14-c dated  3rd January 2009, u/s 79 (A) of MCS Act and the office of the Dy. Registrar of Co- Operative Societies was given the authority to appoint the Authorised officer oversee the selection process of a Developer/Builder.

 

Having the above background, and context, you are requested to give copies/information of the following.

 

a)         Please provide names and addresses of co-operative housing societies under your jurisdiction, those followed the Govt. circular cited above for the redevelopment, seeking your permission to oversee selection of the Developer/Builder, from period January 2009 till date.

 

b)         Please provide names of the Authorised officer appointed by the office of the Dy. Registrar, in each co-operative housing societies mentioned at para ‘a’ above. Please provide photocopies of letter/order issued in this regard.

 

 

c)         Please provide names and addresses of co-operative societies to whom you have issued No objection certificate or a letter, conforming/complying with the procedure laid down in the Govt. circular for redevelopment on selecting the Developer/Builder has been adhered to. Please provide photocopies of your letter/No objection certificate issued to various societies in this regard from January 2009 till date.

 

d)         Please also provide names and addresses of co-operative societies

against whom you have initiated action or issued notice or passed an      order for NOT following the procedure laid down in the above cited  Govt. circular for redevelopment in selecting the Developer/Builder.

 

e)         Please provide names and addresses of co-operative societies whose applications are pending with the Office of the Dy. Registrar for appointment of the Authorised Officer, to oversee the selection of Developer/Builder for the redevelopment, of their respective buildings. Please also inform the time period since when the application is pending with the Office of the DY. Registrar.

 

f)          Please also inform the total number of registered co-operative societies under your jurisdiction and the geographic area covered in north, south, east and west of the Mumbai suburbs.

You are requested to inform me the cost of copies involved, as per the RTI Act, to enable me to deposit the same in cash in your treasury/office.

 

You are requested to provide the above information at your earliest which will be collected in person through authorised representative of the undersigned.
