RTI to reveal malpractice

Dear Sir,

It has been learnt that the Indian Institute of Management Calcutta (Under Ministry of HRD, Govt of India) adopts malpractice  for recruitment in the institute particularly in the administrative posts. They advertise for a post seeking high qualifications and experience of the candidates in specific edition of a newspaper.   As high qualifications and several years of experience are sought in the advertisement, it scares away many candidates even  to apply. Then it becomes easy for them to select a candidate of their choice even when the selected candidate is not having qualifications and experience as sought in the so called advertisement. As many people do not even apply for the posts as high level of qualifications and experience are sought, it goes unnoticed. The following RTI query will reveal it.

 Sub: Seeking information under RTI Act, 2005

 

Dear Sir / Madam,

There has been recruitment of Administrative Officer, Chief Administrative Officer, General Manager (Org. Development & Admn) etc. in IIM Calcutta in 2011. In connection with the recruitment in these three posts in 2011, the following information are sought under RTI Act, 2005.

1)      Copy of the advertisements for the posts

2)      In which newspapers and editions these advertisements were published on which day?

3)      Name, qualifications, years and nature of experience of the candidates, who have been selected in the posts of Administrative Officer, Chief Administrative Officer, General Manager (Org. Development & Admn) in the institute in 2011 and the date of their posting.

4)      Copy of the bio-data (CV) submitted by the selected candidates in these three posts.

5)      Comparative statements showing Name, qualifications and years and nature of experience of the candidates, who applied and / or interviewed  for these three posts but were not selected.

    Preferred language in which information is desired is Hindi or English. If the information you are providing me is more than 25 pages please provide it to me in the form of a compact disc. If the information doesn’t pertain to your office please forward it to the correct office under Section 6(3) of the Right to information Act.

    Dear Mr sunilsharma,

    PIO’s reply has not been received so far. When received it will be definitely posted here. Despite 30-day limit, PIOs sometimes delay their response. Sometimes they try to give excuse of postal delays, at other times there is no excuse at all. This is a problem with many PIOs so we are trying to take it up with the Central Information Commission, along with some other similar issues. Please see application no.10990 (application no. is found on top on the address bar. For instance, your application no. as you can see on top of this page is 7849) In fact, you may also add your own comment on the page for Application no. 10990, because after all it is the applicant who really suffers so your direct views about this attitude by PIOs will be quite useful.

    This is exactly why you were asked to write this problem in application number 10990, which you have not done so far. It is not only your problem. Many are facing it, so we’ll take it up together.

    Even after so many days,when the information have not been provided, it is a reasonable apprehension that the PIO (or the authority)does not want to part with the information.

    Dear Mr Sunil Sharma,

    Regret to note your plight. Please check up Indiapost website to see if this speedpost packet ever reached your PIO. The speedpost consignment number is ED 404018833 IN as mentioned above in the comment of 04 January 2012. It seems it never reached. Nobody at RTI-Anonymous also checked; sometimes at RTI Anonymous our team members are too busy trying to find faulty with work of other team members than to focus on requirements of applicants.

    Speedpost system in our country is afflicted with the same ailment of carelessness that rest of govt departments. Common citizens are being cheated and defrauded bigtime in every manner possible by govt bureaucracy. We need to all get together and stay together to fight it. Now I suggest to you as follows. Buy a Rs10 Postal Order from the nearby post office. Then download the application attached above in comment of 31 December 2011. Only change the date and postal order no. Then send it by speedpost to the PIO and mention the consignment number here, and keep track of it. No point sending appeals etc if PIO has never received your application.     there is a very simple and cheapest way to avoid postal errors, but its a bit slow. Locate a head post office near by, and submit your application to post master. You can also pay by cash and get the receipt. Your application will be forwarded(transfered) to respective departments. You will get the intimation on such transfer. This intimation will act as a proof of your rti application being sent. You can save on the speed post cost, but there will be a delay of 10 days. First appeal & second appeal can be filed through this method.

      Nice suggestion, if workable.

      Can any HPO be approached, or only the one nearest to one’s residence? If I want to send a letter to a PIO of an office in Chennai, and it has to go in Ritesh’s name with address of IIT Kharagpur, will the postmaster of Powai In Mumbai accept the letter? Further, isthis procedure only for letters to PIOs or any letterto anyone? Also, can the letter be in a sealed envelope or must it be open sheets? Intimation of “transfer” will be given: Does transfer here mean delivery of letter to consignee? So when envelope is delivered an intimation will come to sender. The intimation will be by aletter written by the post master to the sender, or thru any other means? If this happens, how is it different from RegisteredAD post? If not so different, why do people still send registered letters which are so much more expensive?

        1) This method of collecting RTI Application by Head Post Office is applicable only to central govt departments & Organizations..

        2) RTI Application should not be put in any envelope, it should be just the application and fee. Post master ( CAPIO ) will first examine the RTI application for
        i) Proper PIO address
        ii) Correct Fee ( usually submitted by way of cash in post office against receipt for it )
        iii) Your signature and declaration that you are Indian Citizen

        3) The Postmaster on the 5th day or before that will dispatch your RTI Application to respective PIO by Registered post. An intimation will be sent to you by Ordinary Post.

        ** This way of submitting RTI Application is not applicable to STATE GOVT

    File a first appeal..

    RTI Applicant need not wait more than 30 days to get the PIO Decision. If he needs legal advice for replying he should have sought it within those 30 days..

    They is no provision in RTI for the PIO to seek time as he needs some legal advice on replying to that.

    If you receive any reply “Even if he denies” file a complaint and present that PIO violated the rules of RTI Act..

      One general query: What happens if applicant fails to file first appeal in allowed time (is it 30 or 60 days?)?

      If he has missed the deadline, does that mean he must start the cycle again with a fresh RTI on same topic?

        When appeal times are missed, just File a complaint u/s 18(1). send this copy to PIO.

        You will get the information from PIO.

        Your next RTI will be treated with most respect.

          Thanks but query not quite answered. Situation is something like this:
          A. I send an RTI application on 01 January 2012.
          B. I should get response by 30 January. I get letter on 29 January, but out of 5 questions, only Q1 and Q2 answered. Address and email of PIO and of appellate authority given in letter.
          C. On February 5, I send reminder to PIO by email to also reply to Qs 3,4 and5. Wait whole February but no reply.
          D. On 10 March I send appeal by email to first appellate authority. No response.
          D. On 4 April, I send appeal by speedpost to first appellate authority with enclosures of my RTI application and copy of PIO’s response.
          E. Now if first appellate authority does not reply (or rejects) my appeal on the grounds that the appeal by speedpost reached him after 60 days of January 30, what remedy do I have?

          Can you answer E?

              If I am applicant and have file RTI on 1st January, but first appeal is sent by me only on April 4th, as per rules first appeal is late.

              So how can I force out answers to my questions?
              I’m waitibng for a simple response from all you knowledgable peoplem,, including Syedbhai.

                Please read the RTI Act 2005.

                If PIO didnt respond and if you missed the time lines of first appeal, then you can use 18(1).

                Otherwise you have to start afresh.

                  This brings some clarity.

                  Now another query, which can be replied by those like you, with experience.

                  I hear that pendency of cases at CIC seems to be 8 to 12 months. Where life or liberty is at question, cases can be dealt urgently.
                  But there may be other situations where so much delay, 8 to 12 months, can cause a severe problem. How to get quick attention from CIC?

                  Suppose the municipality starts digging all around someone’s house and gives no clear info on the project. When victim write to PIO, he must allow 30 days to reply. Then victim write to 1st App Authority, again allowing 30 days. Then he writes to CIC. By now digging already going on for 80-90 days. If CIC takes 8 to 12 months, everything will be lost by then. In such situation, how to get quick intervention by CIC? Almost every appellant must be requesting for urgent action. How to make CIC take up our case quickly?

                    File the complaint, call the CIC helpline number and explain your position..

                    Recently I tried to push my second appeal up in the queue, and it was taken up for hearing…
