What has been done to bring noise levels to mandated 45-65 db

Environmental protection act and supreme court orders in WP #20050718 mandating 45-65 db levels and no honking or noises between 10pm to 6 am, to protect public health,  wellbeing, and environment are one decade old.

The EPA enforcement authorities-Karnataka state pollution control board, police, Transport department etc have failed to effectively implement the orders against, offenders like vehicles fitted with airhorns, musical horns, altered silencers etc and especially against the manufacturers and dealers of these torture instruments.

Every noise per second affects 8000 uninvolved innocent public in a densely populated city like Bangalore(24000/sq km).

Repeated complaints petitions over the years  to the authorities have not resulted in any concrete stringent steps to tackle the problem. They need to do it on a war footing otherwise they should be liable for contempt of court proceedings and consequences on an ongoing basis until the orders are complied with.

One can see that the quality of life will dramatically improve with enforced silence taking us up immediately to the civilized society level from a barbaric age.

    Sir,

    It seems that the Karnataka State Pollution Control Board is mainly responsible for air and water pollution. If you suggest an appropriate authority in this matter we can file an RTI to find out if there have been any actions taken on the violators of the Supreme Court guidelines.

    2 commissioner transport for specific action taken against
    a. owners of vehicles fitted with illegal horns b. modified illegal silencers c. manufacturers and dealers of illegal horns d. tracking of repeat offenders. e.imposing mandatory penalties the more stringent Environment protection act rather than the 100 rs fine under central motor vehicles act.
    for more effective implementation of the epa & supreme court mandates saving 8000 innocents hearing from permanent irreversible damage.

    I am not yet clear about the competent authority in this case. I am being sticky about this because we will unnecessarily loose time if the RTI application goes to a wrong department. We can avoid this by being sure of the department to which this application should go to. Is it covered by Road transport authority or traffic police or pollution control board? It is clear on the website of pollution control board that they deal only with the air and water pollution.

    legally speaking kspcb-since they have issued diwali advisory specifying noise levels of crackers, timings etc, are the logical authority. they should also be the one to go after manufacturers and dealers and ep act is more stringent on violations. Transport commissioner as i understand can only go after illegally fitted vehicles. May be the chief secretary or home ? just transport commissioner should be sufficient. based on his response i could approach the chief secretary?

      seems perfectly fine, First question could be to point out this is a very old settled issue not implemented leading to serious loss of quality of life under article 21

    i am the resident of JP nagar 7th phase bangalore BOB colony 4 th main. this is a residential area and there are lot of stone crushing machines which runs continiously24*7*365 and spreads tremendous pollution, noise is unbearable for near by residents even some time we cant even sleep in nights due to that.

    Supreme court even ordered to shift machines from the residential areas to safer zones same can be cheeked on this url

    You people are talking about the noise pollution spreaded by the vehicles thats is very small thing we people of JP nagar 7th phase BOB colony 4th main are living under unhunman condition. lot of stone crushing machines are there in this residential area and spreading huge noise pollution 24*7*365 days.it dont know some day we may dead with severe disease due to these machines polluting whole area. we send lot of mails to Karnataka pollution board but no response from them.

    Do not waste too much time in deciding the authority whom to apply, you file the RTI whrever you think proper, As per the ACT it is the responsibility of the receiving authority to forward the application to the proper authority within 5 working days and inform you,
