Promotion of Assistant Directors in the department of Statistics
Dear Sir,
I am a retired Officer of Directorate of Economics and statistics, Govt. of Karnataka, I was promoted as Assistant Director in the year 2005 (August) a total of 45 persons were promoted on the said date on temporary basis (Rule 32) Independent Charge, then I was working as a P.A to His Excellency the Governor of Karnataka, (Computer Centre) Bangalore. Now after a period of 6 years the department(Planning) has regularize the promotion and only 42 in the list of 2005 has been considered on the grounds that one has not opted the promotion and the 2 of us(myself and a Friend) are retired.
In the original list of 2005 my serial number was 28 and the same list I have been listed referred as 38 (the difference of 10 members), I have submitted my requests to The Principal Secretary, Dept. of Planning and the Director, Director of Economics and Statistics, M S Buildings, Dr. B R Ambedkar Veedhi, Bangalore-1 to consider our names for promotion, but nothing has been heard from both the Officer. I wonder how my serial number 28 has been changed to 38 and thereby deprived me of my promotion and thereby Financial benefits in these days of hardship.
Please help me in getting JUSTICE.

From what u have made out, it can be said that u were placed in independent charge of tje higher post from 2005. This must be under Rule 32 of KCSRs.This is actually not promotion but only placing you under independent charge. If this arrangement is later regularised from a retrospective date, then it can be said that you are said to be promoted retrospectively. But it looks from what u have stated that promotions are now made from a prospective date. Since u r retired at this date, ur case may not have been considered. Anyhow, pl see if this is correct. U can insist for a reply for your
representation already made by you.

Please treat my case under RTI as I was pushed to 38 serial number from 28 but which is actually resulted in my non promotion.

Thanks for analyzing my case, it is true that I was retired on the day of the orders. But it is so happened that my seniority was moved from 28 to 38 which means within the list of 45 i was pushed down to 38 which made me to miss the bus. Now what I want is how this has been done, in spite of my representation I have not been answered thus Under RTI I want to know how I was pushed down by 10 members(Seniority). Thus I request you to get the answers under RTI since the final promotion the same list of 45 of 2005 has been referred.

Mr.Khuddus,Since this is a personal case, u have only a legal remedy. Pl consult an advocate for a legal recourse.
Dear Sir,
In support of my claims I will e sending you the letters(scanned)by this week end.
so please file my case under RTI as I have been dropped from the list. Further there are 13 reserved category persons in my list all below my seniorty in spite of this they have been promoted more than once.
So please bear with me till I send you the copies of the letter which are self explanatory.

P.S Justice delayed is justice denied
delay leads to corruptions!
As already brought out above,legal remedy is the only wayout. This is something connected with ur service condition. In fact under section 4 of the RTI Act,the public authority has an obligation to disclose the gradation list of the employees which u may ask. Any discrepency in the list is to be fought only with the employer under the grievance redressal system of the dept.and not under RTI Act
